Minutes note: Recommendation of a 20-day suspension in lieu of the revocation of the Class "B" Tavern and Cabaret license of Michael F. DeSautel for the premises at 4177 S. Howell Avenue ("Daddios") in the 13th Aldermanic District. Written objections have been filed by the licensee. (Committee Vote: 3 Ayes; 2 Noes; Expiration Date: 5-13-01).
The President questioned whether the members of the Common Council read the Report and Recommendations of the Utilities and Licenses Committee in this matter and any written exceptions, if filed by the licensee?
Ayes: 17 - Ald. Herron, D'Amato, Henningsen, Bohl, Johnson-Odom, Gordon, Donovan, Richards, Cameron, Scherbert, Sanchez, Pawlinski, Breier, Nardelli, Murphy , Hines and President Pratt.
Noes: 0.
THE CLERK asked whether the applicant or his counsel or any of the complainants were present and wished to address the Council.
The following were present:
Michael F. DeSautel, Attorney Michael Arena, applicants counsel, Eugene Vlies, Susan Prothero, Janet Breitzman, Agapito Cruz, Shirley Chiaverotti, Craig Plain.
Attorney Andrew Arena and Craig Plain wished to speak.
ALD. SANCHEZ moved that the Common Council do now resolve into the Committee of the Whole for the purpose of hearing from the Counsel for the licensee, the Complainant and the City Attorney's Office.
PROCEEDINGS OF THE COMMITTEE OF THE WHOLE
Complaint Mr. Craig Plain, Attorney Andrew Arena and Assistant City Attorney Bruce Schrimpf appeared and addressed the Committee relative to the foregoing matter.
ALD. SANCHEZ moved that the Committee do now rise.
The motion prevailed.
ALD. PAWLINSKI moved to amend the license of Michael F. DeSautel Class "B" Tavern and Cabaret license for the premises at 4177 S. Howell Avenue ("Daddios") by revocating said license notwithstanding the Utilities and Licenses Committee Recommendation.
The motion prevailed by the following vote:
Ayes: 12 - Ald. D'Amato, Bohl, Johnson-Odom, Gordon, Donovan, Richards, Scherbert, Pawlinski, Breier, Nardelli, Murphy and Hines.
Noes: 5 - Ald. Herron, Henningsen, Cameron, Sanchez and President Pratt.
ALD. PAWLINSKI moved to approve File Number 010100 as amended.
The motion prevailed by the following vote:
