Title
Resolution releasing the drainage easement located on 3407 and 3415 South 77th Street, and 3406 and 3414 South 78th Street, in the 11th Aldermanic District of the City of Milwaukee. (Infrastructure Services Division)
Analysis
This resolution will release a drainage easement on 4 properties known as 3407 and 3415 South 77th Street, and 3406 and 3414 South 78th Street because the easement is no longer necessary.
Body
Whereas, A 12-foot wide easement for drainage purposes was created as part of the original subdivision plat for Ohio Meadows being the block bounded by West Ohio Avenue, West Verona Court, South 77th Street and South 78th Street; and

Whereas, The east-west drainage easement is located on the properties known as 3407 and 3415 South 77th Street, and 3406 and 3414 South 78th Street; and

Whereas, The property owner at 3407 South 77th Street, requested that the drainage easement be released so that they could get a building permit to construct a garage within the easement limits on their property; and

Whereas, A review of the drainage patterns within this block have changed so that the drainage easement is no longer necessary; now, therefore, be it

Resolved, That the Common Council of the City of Milwaukee hereby releases the drainage easement located on the properties known as 3407 and 3415 South 77th Street, and 3406 and 3414 South 78th Street; and, be it

Further Resolved, That the City of Milwaukee is held harmless for any adverse drainage situation which may occur in the future due to the release of this easement; and, be it

Further Resolved, That the City Comptroller is hereby authorized and directed to have a certified copy of this resolution recorded in the office of the Register of Deeds of Milwaukee County against each of the following properties:
