Resolution authorizing acceptance of engineering design funds and authorizing the proper City Officers to execute an Out-of-Program Agreement between the Heritage Land Company, a developer, and the City of Milwaukee for construction of public improvements to serve a residential subdivision known as Heritage Meadows Addition No. 1 generally located south of West Heritage Drive, west of North 107th Street, east of North 114th Street and north of West Jonen Street extended. Analysis

This resolution authorizes the Commissioner of Public Works to accept a developer deposit for design engineering of public improvements to serve a residential subdivision generally located south of West Heritage Drive, west of North 107th Street, east of North 114th Street and north of West Jonen Street extended.  The resolution also authorizes City Officers to execute an Out-of-Program Agreement regarding construction and funding of the necessary public improvements for the project.  The developer will be responsible for all costs associated with the public improvements.  Depending upon circumstances, either the developer or the City will contract for construction of those improvements.

Body

Whereas, Heritage Land Company, a developer, desires to enter into an Out-of-Program Agreement with the City of Milwaukee regarding the design and installation of public improvements to serve an 18 lot single family residential subdivision known as Heritage Meadows Addition No. 1; and

 

Whereas, Heritage Meadows Addition No. 1 is generally located south of West Heritage Drive, west of North 107th Street, east of North 114th Street and north of West Jonen Street extended; and

 

Whereas, The Out-of-Program Agreement for the development is attached to this file; and

 

Whereas, Under the terms of the agreement the proposed public improvements would be designed and installed at no cost to the City of Milwaukee; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement attached to this file is hereby approved and the proper City Officers are hereby authorized to execute said agreement on behalf of the City of Milwaukee; and, be it

 

Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes to the Out-of-Program Agreement prior to its execution.
