Whereas, Common Council File Number 130211 reserved up to $460,000 from the 2013 Common Council Contingent Fund for the Outside Counsel/Expert Witness Fund Special Purpose Account for expenses relating to the City Hall restoration litigation; and,
Whereas, the City Attorney has determined that all $460,000 is not needed in 2013 for these purposes; and,
Whereas, the City Attorney has identified a need for $220,141 for legal services performed on behalf of the City in the Reep sewer overflow case with payment due before the end of 2013; and,
Whereas, there is not sufficient funding in the Outside Counsel/Expert Witness Fund for the Reep case expenses; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the $460,000 previously reserved and appropriated from the 2013 Common Council Contingent Fund (0001-9990-C001-006300)(2013) to the Outside Counsel/Expert Witness Fund (0001-1490-0001-S157)(2013) for City Hall restoration litigation expenses in Common Council File Number 130211 be reduced to $239,859; and, be it
Further Resolved, that $220,141 shall be appropriated and transferred from the 2013 Common Council Contingent Fund (0001-9990-C001-006300)(2013) to the Outside Counsel/Expert Witness Fund (0001-1490-0001-S157)(2013) for the purpose of paying legal expenses for the Reep sewer overflow case; and, be it
Further Resolved, That the City Comptroller and other appropriate City officials are authorized and directed to take whatever steps are necessary to fulfill the intent of this resolution.
