Analysis
This resolution authorizes the Commissioner of Public Works and Comptroller to execute a Project Agreement with the Wisconsin Department of Transportation for the preliminary engineering and design, equipment purchase and installation, and participating construction for Phase 1 of a public bike sharing system using Congestion Mitigation and Air Quality program funds for projects in various Aldermanic Districts. The agreement provides 80% Federal funding and 20% local cost sharing for the preliminary engineering and design, equipment purchase and installation, and participating construction to implement Phase 1 of a public bike sharing system. The resolution also directs the City Comptroller to create the necessary accounts to fund the City of Milwaukee's share of the preliminary engineering and design, equipment purchase and installation, and participating construction for this project. The total estimated cost of this project is $1,600,000 with an estimated grantor share of $1,280,000, and an estimated City share of $320,000.
Body
Whereas, Preliminary approval has been requested and received from the Wisconsin Department of Transportation, along with a Project Agreement to be executed by the City of Milwaukee, for the preliminary engineering and design, equipment purchase and installation, and participating construction for Phase 1 of a public bike sharing system under the Congestion Mitigation and Air Quality program; and
Whereas, The Congestion Mitigation and Air Quality program was implemented to support surface transportation projects and related efforts that contribute air quality improvements and emissions reductions through improved transportation options and traffic congestion relief; and
Whereas, the Wisconsin Department of Transportation has submitted this Project Agreement for execution by the City of Milwaukee for the preliminary engineering and design, equipment purchase and installation, and participating construction of Phase 1 of a public bike sharing system:

; and
Whereas, The State cannot proceed with any project cost overruns or changes in scope of more than 5% without prior Department of Public Works approval; and
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns or changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns or changes in scope as approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and Comptroller are authorized to execute this Project Agreement for the preliminary engineering and design, equipment purchase and installation, and participating construction of Phase 1 of a public bike sharing system with Congestion Mitigation and Air Quality Program funds, copies of which are attached to and incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That the proper City of Milwaukee official is hereby directed to undertake for the preliminary engineering and design, equipment purchase and installation, and participating construction for the above-mentioned projects and to reimburse the Wisconsin Department of Transportation for preliminary engineering costs they incur for the improvements; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital
Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for the preliminary engineering and design, equipment purchase and installation, and participating construction for the project (expenditure) and transfer to any of these accounts the amount required under this grant agreement and City Accounting policy but not to exceed a 10 percent increase of the total amounts reserved for the grantors share or $5,000, whichever is greater, as follows:
