Body
Whereas, Ronald Karow has obtained legal counsel for the purpose of obtaining recovery for personal injuries sustained in an automobile collision occurring on March 2, 2000; and
Whereas, As a result of the injuries allegedly sustained as a result of that accident, the City of Milwaukee has made payments on behalf of Ronald Karow for medical care and treatment pursuant to its Basic Health Plan in the amount of $122,430.30; and
Whereas, The City has a subrogation claim against Ronald Karow as a result of such payments; and
Whereas, The insurance coverage available to compensate Ronald Karow for his injuries is limited to $100,000, and his counsel has requested that the City of Milwaukee cancel its subrogation lien in the matter on the grounds that the insurance amount is insufficient to make Mr. Karow whole for the injuries he sustained; and
Whereas, The Common Council finds that such amount would be insufficient to make Mr. Karow whole for the injuries sustained; and
Whereas, Cancellation of this lien reflects the legal liability of the parties and is a fair and equitable resolution of the City of Milwaukee's subrogation claim; now, therefore be it
Resolved, By the Common Council of the City of Milwaukee that the subrogation claim of the City of Milwaukee against Ronald Karow arising out of medical treatment for injuries allegedly sustained as a result of the March 2, 2000 automobile collision is hereby cancelled in the amount of $122,430.30, and the City Attorney is authorized and directed to enter into a release and settlement of said claim.
