Resolution authorizing and directing the proper City Officers to execute an Out-of-Program Agreement between Wal Mart Stores, Inc. and the City of Milwaukee for construction of public road improvements to enhance access for a new Wal Mart store to be located at the southeast corner of North Servite Drive and West Brown Deer Road. (DPW)

Analysis

This resolution approves an Out-of-Program Agreement between the City of Milwaukee and Wal Mart Stores, Inc.  The agreement provides for the construction and funding of public road improvements which will enhance access for a new Wal Mart store to be located at the southeast corner of North Servite Drive and West Brown Deer Road.  In sum, the agreement stipulates that the developer will fund and construct, under permits issued by the City of Milwaukee or the State of Wisconsin, various access improvements intended to lesson the impact of the project on nearby public streets

 

Body

Whereas, Wal Mart Stores, Inc. (the Developer) intends to construct a new store at the southeast corner of North Servite Drive and West Brown Deer Road; and

 

Whereas, This store is expected to generate a significant amount of traffic; and

 

Whereas, The traffic impacts that will result from the new store can be mitigated by making several improvements to the public streets in the immediate area; and

 

Whereas, The proposed traffic improvements were identified in a traffic study for the project performed by Traffic Engineering Services, Inc. under contract to McClure Engineering; and

 

Whereas, The Developer now desires to enter into an Out-of-Program Agreement with the City of Milwaukee to provide for the proposed road improvements; and

 

Whereas, All of said road improvements will be made at no cost to the City of Milwaukee; and

 

Whereas, The Out-of-Program Agreement for this project is attached to this file; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement attached to the file is hereby approved and the proper City Officials are hereby authorized and directed to execute said agreement on the behalf of the City; and, be it

 

Further Resolved, That the Commissioner of Public Works is authorized to make minor, non substantive changes to the Out-of-Program Agreement prior to its execution.
