This substitute resolution approves an Out-of-Program Agreement between the City of Milwaukee and August Urbanek. The agreement provides for the construction and funding of public improvements for a four lot single family residential subdivision in conjunction with the Heritage Heights development located westerly of North 107th Street at West Kiehnau Street. In sum, the agreement stipulates that the City will design and install a water distribution system and public streets, the developer will provide the initial funds, and the City will ultimately refund the non assessable portion of the water improvement cost, any assessments collected from other benefitting property owners, and a protated share of the cost to repair certain street segments in the immediate area.

BODY:
Whereas, August Urbanek plans to develop a four lot, single family home subdivision as the next phase of the Heritage Heights residential community; and

Whereas, Heritage Heights is located generally westerly of North 107th Street and north of West Kiehnau Street; and

Whereas, The planned four lot addition to Heritage Heights will require water and public street improvements; and

Whereas, Certain unfinished street segments in the immediate area require the laying of a new base course; and

Whereas, The developer now desires to enter into an Out-of-Program Agreement with the City of Milwaukee to provide for the construction and funding of the required public improvements; and
