- Analysis -

 

This ordinance deletes the requirement that a vehicle must have an overnight parking permit to park on the street between 2 a.m. and 6 a.m. The ordinance also increases the forfeiture for overnight parking violations (alternate side parking) from $10 to $15. The ordinance takes effect January 1, 2001.

BODY:

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 81-85 of the code is repealed.

 

Part 2. Section 101-27-2 of the code is repealed and recreated to read:

 

101-27. All Night Parking.

 

2.                     NIGHT PARKING PERMITTED. a. Vehicles may be parked between the hours of 2 a.m. and 6 a.m. as provided in this section.

 

b.                     The owner of any motor truck with valid license plates issued by the Wisconsin department of transportation, division of motor vehicles, but not used for commercial purposes and that is not larger than 21 feet in length, 7 feet in width and 7 feet in height and that has no more than 4 single-tired wheels, may park as provided in this section.

 

Part 3. Section 101-27-4 of the code is amended to read:

 

4.                     CERTAIN VEHICLES [[NOT ELIGIBLE]] >>PROHIBITED<<. Motor trucks, except as provided elsewhere in the code, luxury limousines, as defined in s. 100-3-11, motor buses, motor delivery wagons, trailers, semitrailers, camping trailers, motor homes, mobile homes and tractors [[shall not be eligible for such special privilege parking permits]] >>are prohibited from parking under this section<< .

 

Part 4. Section 101-27-5 and 6 of the code is repealed.

 

Part 5. Section 101-27-7-b and f of the code is repealed.

 

Part 6. Section 101-27-7-d of the code is amended to read:

 

7.                     EXCEPTIONS.

 

d.                     Night Business Establishment Areas. Parking shall be permitted during [[prohibited]] >>the<< hours [[(]] >>of<< 2 a.m. to 6 a.m.[[)]] for a period of time not to exceed one hour in the same block of a business establishment licensed by the city and open for business during such [[otherwise prohibited]] hours. For penalty, see s. 101-34-2-b.

 

Part 7. Section 101-27-7-g of the code is repealed and recreated to read:

 

g. Disabled Plates and Identification. A vehicle bearing a current registration plate for a disabled driver issued under s. 341-14(1), (1a), (1m) or (1q), Wis. Stats., or displaying a current special identification card issued under s. 343.51, Wis. Stats., shall comply with the requirements of this section.

 

Part 8. Section 101-27-8 of the code is amended to read:

 

8.                     WINTER REGULATIONS. After 8 p.m. on December 1 to March 1 inclusive, unless otherwise extended by emergency order of the commissioner of public works, [[of the year following, no special permits shall be issued for parking]] >>there shall be no parking<< upon any through [[highways]] >>highway<< referred to in s. 101-16-2, nor upon those portions of any street upon which there is operated a motor bus route, except upon any snow route tow-away zone as referred to in s. 101-24-1 and except as provided in sub. 9.

 

Part 9. Section 101-27-11 of the code is amended to read:

 

11.                     [[PERMIT]] >>PARKING<< RECIPROCITY. a. St. Francis. where S. Brust Avenue, Clement Avenue, Hanson Avenue, Kansas Avenue, Nevada Street; and E. Norwich Street lie on the boundary between the city of Milwaukee and the city of St. Francis, all night parking permits issued by the city of St. Francis shall become valid in the city of Milwaukee to the same extent as if such permit had been issued by the city of Milwaukee provided, however, that the provisions of this paragraph shall be effective only during such time as the city of St. Francis authorizes, by ordinance, a reciprocal privilege on such streets for all night parking [[permits issued by]] >>without permits or fees by residents of<< the city of Milwaukee.

 

b.                     West Milwaukee. Where S. 38th Street and W. Greenfield Avenue lie on the boundary between the city of Milwaukee and the village of West Milwaukee, all night parking permits issued by the village of West Milwaukee shall become valid in the city of Milwaukee to the same extent as if such permit had been issued by the city of Milwaukee provided, however, that the provisions of this subsection shall be effective only during such time as the village of West Milwaukee authorizes, by ordinance, a reciprocal privilege on such streets for all night parking [[permits issued by]] >>without permits or fees by residents of<< the city of Milwaukee.

 

Part 10. Section 101-34-2-a of the code is amended to read:

 

101-34. Stipulation Procedure; Nonmoving Traffic Violations.

 

2.                     FORFEITURE SCHEDULE.

 

a.                     Citations issued for violation of s. 101-27 except 101-27-1-a and 4: [[$10]] >>$15<< .

 

Part 11. Section 101-34-7-a of the code is amended to read:

 

7.                     PENALTY.

 

a.                     Violations of s. 101-27 except s. 101-27-1-a and c: [[$10 to $40]] >>$15 to $45<< .

 

Part 12. This ordinance takes effect January 1, 2001.
