Analysis
This resolution authorizes the Commissioner of Public Works and Comptroller to execute a State Municipal Agreement with the Wisconsin Department of Transportation for the programming and construction of roadway geometric improvements on East Ward Street at its intersections with South Allis Street and East Bay Street using funds provided under the Wisconsin Department of Transportation 2014-2015 STP - Freight Pilot Program to improve freight access to the Port of Milwaukee.  The total estimated cost of the projects is $122,000 with a grantor share of $94,400 and a City share of $27,600. The total estimated preliminary engineering cost for this project is $22,000, with a grantor share of $17,600 and a City share of $4,400.  Approval of construction costs will be in a future resolution.

Whereas, A Wisconsin Department of Transportation 2014-2015 STP - Freight Pilot Program Project Grant Application was submitted for the improvement of intersection roadway geometrics on East Ward Street at its intersections with South Allis Street and East Bay Street to support more efficient movement of oversized freight loads to and from the Port of Milwaukee; and
 
Whereas, Preliminary approval has been requested and received from the Wisconsin Department of Transportation, along with a State Municipal Agreement to be executed by the City of Milwaukee, for the programming and construction of this project under the Wisconsin Department of Transportation 2014-2015 STP - Freight Pilot Program; and
 
Whereas, The Wisconsin Department of Transportation has prepared a State Municipal Agreement for execution by the City of Milwaukee for the design and construction of:

; and
 
Whereas, The State cannot proceed with any project cost overruns or changes in scope of more than 5% without prior Department of Public Works approval; and
 
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and/or changes in scope approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns or changes in scope as approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and the Comptroller are authorized to execute a State Municipal Agreement for the programming, and the design and construction, of the aforementioned project with Wisconsin Department of Transportation 2014-2015 STP - Freight Pilot Program funds, a copy of which is attached to and incorporated in this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That the proper City of Milwaukee official is hereby directed to complete preliminary engineering for the above-mentioned project and to reimburse the Wisconsin Department of Transportation for preliminary engineering costs they incur for the improvements; and, be it
 
Further Resolved, That the Department of Public Works shall request in a future resolution funding for the construction phase of this project; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for preliminary engineering for the project (expenditure) and transfer to any of these accounts the amount required under this grant agreement and City Accounting policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and the local share or $5,000, whichever is greater as follows:
