Resolution authorizing the Commissioner of Public Works to execute utility agreement with the State of Wisconsin Department of Transportation for work on City of Milwaukee Sanitary Sewer facilities in conjunction with the Zoo Interchange's Core Phase 1 contract work.
Analysis
This resolution approves the entitled Agreement for Payment for the Relocation or Replacement of Municipal Utility Facilities Located on Public Held Land Required by Freeway Construction for City of Milwaukee Sanitary Sewer facilities, and authorizes the Commissioner of Public Works to execute the agreement on behalf of the City of Milwaukee.
 
This agreement relates to utility work on City of Milwaukee Sanitary Sewer facilities necessitated by the rehabilitation of the Zoo Interchange Core Phase 1 contract being undertaken by the Wisconsin Department of Transportation in 2014.  This agreement provides generally for the City to be reimbursed from the State 90 percent of the City costs for all work on City of Milwaukee Sanitary Sewer facilities necessitated by the freeway rehabilitation project in accord with Wisconsin State Statute 84.295(4m).
 
This resolution also authorizes the Commissioner of Public Works to prepare and review plans and estimates for the Zoo Interchange utility work as necessary to accomplish the project. This resolution also authorizes the Comptroller to establish accounts as necessary to track the work and to submit invoices to the State of Wisconsin for work undertaken on this project as approved by the Commissioner of Public Works, for a total amount of $30,000 with a City share of $3,000.
 
Body
Whereas, The State of Wisconsin Department of Transportation has scheduled the reconstruction of the Zoo Interchange in the City of Milwaukee, Milwaukee County; and
 
Whereas, There will be work required on City of Milwaukee Sanitary Sewer facilities as a result of the design and construction associated with the Zoo Interchange freeway work; and
 
Whereas, Wisconsin State Statute 84.295(4m) indicates that the Wisconsin Department of Transportation will pay 90 percent of the cost of alteration, rehabilitation and relocation of municipal utilities with the responsible jurisdiction liable for the remaining 10 percent of the cost; and
Whereas, The estimated City costs for review of City of Milwaukee Sanitary Sewer facilities alteration for Department of Public Works/ Infrastructure Services Division will be $30,000 with the City of Milwaukee 10 percent share being $3,000 for City of Milwaukee Sanitary Sewer facilities related to the Zoo Interchange's Core Phase 1 project State Project ID 1060-33-07/80; and
 
Whereas, In order for the City of Milwaukee to be reimbursed for the 90 percent share of the engineering review cost on the Zoo Interchange freeway work, the Wisconsin Department of Transportation requires the entering into Municipal Utility Agreement Number (UA 641), in accord with relocation assistance policy; and
 
Whereas, The Wisconsin Department of Transportation has provided the City of Milwaukee with the necessary municipal utility agreements to facilitate reimbursement of City costs in the alteration of City of Milwaukee Sanitary Sewer facilities; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute the Utility Agreement Number (UA 641) for City of Milwaukee Environmental Engineering Sewer facilities, attached to this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to review and prepare plans as necessary to accomplish the required City of Milwaukee Sanitary Sewer facility alterations associated with the Zoo Interchange freeway work and is authorized to allow Wisconsin Department of Transportation to include City of Milwaukee Sanitary Sewer facility work in the Zoo Interchange freeway work contract associated with the Zoo Interchange project and, be it
 
Further Resolved, That the City Comptroller is hereby authorized and directed to create within the Capital Improvements Fund, Grant and Aid Projects, the necessary project grant chart field values for engineering review for the project expenditure and transfer to any of these accounts the amounts required under the grant agreement and city accounting policy but not to exceed a 10 percent increase of the total amounts reserved for the grantors share and local share of $5,000.00, whichever is greater, as follows:
