A substitute ordinance relating to refunding of overpayments of special assessments.

Existing regulations authorize any property owner who overpaid a special assessment after January 1, 1995, to receive a refund of the overpayment. The refund request must be made within 2 years of the initial billing. This ordinance authorizes any person who overpaid a special assessment in 1994 to receive a refund, if he or she submits clear and convincing proof of the overpayment and makes a written request for the refund no later than March 1, 2000.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Excess funds resulting from overpayment in 1994 of a special assessment under s. 115-42-8-a shall be refunded to the person who made the overpayment, if the payer submits clear and convincing proof of the overpayment and makes a written request for the refund no later than March 1, 2000.
