Substitute resolution to vacate a portion of the public sidewalk area on the North Side of East Seeboth Street beginning 4 feet East of the east line of South 2nd Street then East approximately 137.5 feet, in the 12th Aldermanic District.

- Analysis -

 

This substitute resolution vacates the above portion of sidewalk in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation will eliminate an existing encroachment and allow for loading dock improvements.

BODY:

Whereas, It is proposed that a portion of the public sidewalk area on the North Side of East Seeboth Street beginning 4 feet East of the east line of South 2nd Street then East approximately 137.5 feet, be vacated pursuant to the provisions of Section 66.297, Wisconsin Statutes; and

 

Whereas, A Pedestrian Easement Agreement has been prepared for execution between the abutting property owner and the City of Milwaukee; and

 

Whereas, This proposed vacation has been reviewed in accordance with Section 81-308-28, Milwaukee Code of Ordinances; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that said portion of sidewalk, as indicated by Exhibit A and bound and described by:

 

That part of West Seeboth Street in the Northeast 1/4 of Section 32, Township 07 North, Range 22 East, described as follows:

 

Commencing at the Southwest corner of Lot 6 in Block 3 of Walkers Point, a recorded subdivision, in said 1/4 Section; thence Easterly along the south line of Lot 6, 4.00 feet to the point of beginning of the land to be described; thence Southerly 15.50 feet, as measured normal to said south line, to a point; thence Easterly, parallel to the south line of Lots 6 and 5 in said Block 3, to a point in the Southerly extension of the east line of Lot 5; thence Northerly, along said Southerly extension to the Southeast corner of Lot 5; thence Westerly, along the south line of Lots 5 and 6 to the point of beginning, is vacated; and, be it

 

Further Resolved, That the executed Easement Agreement be approved as part of this proposed vacation, as indicated by Exhibit B; and, be it

 

Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, such vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair, with reference thereto shall continue as if said portion of sidewalk had not been vacated.
