Title
Substitute resolution to vacate the right-turn lane located on the Northwest corner of South 2nd Street and West Mitchell Street, to declare the proposed vacated area surplus to municipal needs, and for the City of Milwaukee to donate this proposed vacated area to La Causa, Inc., for no monetary consideration, in the 12th Aldermanic District.
Analysis
This substitute resolution vacates the above portion of street in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation is necessary for the construction of a social service facility.
Body
Whereas, It is proposed that the right-turn lane located on the Northwest corner of South 2nd Street and West Mitchell Street be vacated pursuant to the provisions of Section 66.297, Wisconsin Statutes; and
 
Whereas, This proposed vacated area has been declared surplus to municipal needs; and
 
Whereas, This proposed vacation has been reviewed in accordance with Section 81-308-28, Milwaukee Code of Ordinances; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that said portion of street, as indicated by Exhibit A, is declared surplus and is bounded and described as follows:
 
That part of public street right-of-way located at the Northwest corner of West Mitchell Street and South 2nd Street in the Northeast 1/4 of Section 5, Township 6 North, Range 22 East, described as follows:
 
Commencing at the Southeast corner of Lot 25 as originally platted in Block 152 of Assessment Subdivision No. 55, a recorded subdivision, in said 1/4 Section; thence Westerly, along the South Line of Lot 25 as originally platted, 140 feet to the Southwest corner of Lot 25 as originally platted; 5 feet to the point of beginning of the land to be described; thence Westerly, continuing along said South Line, 135 feet to the Southwest corner of Lot 25, as originally platted; thence Northerly, along the West Line of Lot 25, as originally platted, 2 feet to a point; thence Northeasterly to a point 9 feet North of, as measured normal to, said platted South Line and 45 feet West of, as measured normal to, the East Line of Lot 25 as originally platted; thence Northeasterly to a point in said platted East Line, said point lying 120 feet North of said platted Southeast corner of Lot 25; thence Southerly, along said platted East Line, 115 feet to a point 5 feet Northerly of said platted Southeast corner; thence Southwesterly to the point of beginning, is vacated; and, be it
 
Further Resolved, That the City of Milwaukee may donate this proposed vacated area to La Causa, Inc., for no monetary consideration; and, be it
 
Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, such vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said portion of street had not been vacated.
