This resolution supports the changes recommended by the Southeastern Wisconsin Regional Planning Commission (SEWRPC)to the proposed Wisconsin "Smart Growth" legislative proposal. The "Smart Growth" legislation creates a state-wide framework for comprehensive land use planning and growth management, refines comprehensive planning in Wisconsin, establishes a state grant program to support comprehensive planning and requires that comprehensive plans be adopted by local ordinance if they are used as a basis for regulatory decisions on development matters.
 
The resolution supports legislative consideration of the "Smart Growth" legislative proposal separately and not as part of the omnibus budget bill. The resolution also supports amending the "Smart Growth" legislation to provide for an advisory review of local comprehensive plans by regional planning commissions, and to require local plans to be consistent with any regional plan. The resolution directs the Intergovernmental Relations Division - Department of Administration to seek the separation of the "Smart Growth" legislation from the omnibus budget bill and also seek the amendment of the "Smart Growth" legislative proposal.
BODY:
Whereas, A "Smart Growth" legislative proposal has been proposed in the Wisconsin Legislature and is currently being considered as part of the state omnibus budget bill; and
 
Whereas, The "Smart Growth" legislative proposal creates a state-wide framework for comprehensive land use planning and growth management, refines comprehensive planning in Wisconsin, establishes a state grant program to support comprehensive planning and requires that comprehensive plans be adopted by local ordinance if they are used as a basis for regulatory decisions on development matters; and
 
Whereas, The "Smart Growth" legislative proposal would significantly affect land use planning and growth management in Wisconsin, local and regional planning authorities and the homes and businesses of Wisconsin residents for generations to come; and
 
Whereas, Legislation of this significance should not be subsumed into the omnibus budget bill, but should be thoughtfully considered as separate legislation; and
 
Whereas, If the "Smart Growth" legislative proposal is included in the omnibus budget bill, it should be amended to provide for regional, county and local planning as practiced in southeastern Wisconsin over the past 3 decades; and
 
Whereas, The Southeastern Wisconsin Regional Planning Commission (SEWRPC) has recommended both separate consideration of this legislative proposal and amendments to some of its components; and
 
Whereas, SEWRPC recommendations are appropriate and should be adopted by the Wisconsin Legislature; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, The Common Council supports the removal of the "Smart Growth" legislative proposal from the omnibus budget bill; and, be it
 
Further Resolved, That the Common Council supports amending the "Smart Growth" legislative proposal to make the following changes as recommended by SEWRPC:
 
1.      Require an advisory review of local comprehensive plans by regional planning commissions prior to adoption of those plans.
 
2.      In those cases where a regional plan in southeastern Wisconsin has been adopted by a county board, require local comprehensive plans in that county to be consistent with the adopted regional/county plan.
 
; and, be it
 
Further Resolved, That the Intergovernmental Relations Division - Department of Administration is directed to seek the separation of the "Smart Growth" legislation from the omnibus budget bill and also seek the amendment of the "Smart Growth" legislative proposal as recommended by SEWRPC and provided in this resolution.
