This ordinance modifies the requirements for rental residences affected by the residential rental property lead-based paint hazard control pilot project. Under the pilot project ordinance, after the department determines that lead safe maintenance of all surfaces except windows has been properly performed, the health department will pay all of the cost of lead hazard reduction on windows. This ordinance specifies that the health department will also pay all of the cost of stabilizing lead-based paint hazards on storm windows and screens that are in sound working condition, provided that lead safe maintenance of all surfaces except windows has already been properly performed.

The pilot project ordinance requires all units to have intact storm windows that are in sound working condition. This ordinance specifies that such storm windows are required for all unit windows in habitable rooms, and further requires all storm windows and screens to be free of lead-based paint hazards.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 66-47-5-g of the code is repealed and recreated to read:

66-47. Lead-based Paint Hazard Control Regulations.

g. All unit windows in habitable rooms shall have intact storm windows that are in sound working condition. All storm windows and screens for the unit shall be free of lead-based paint hazards.
