This resolution is in response to a Common Council directive which requires the Commissioner of Public Works to determine any benefits and damages accruing or arising from a vacation. Since the vacation is in a renewal area, as defined by Ordinance 234 of the Milwaukee Code of Ordinances passed July 11, 1961, benefit assessments will not be levied.
 
 
BODY:
Whereas, The Common Council on September 23, 1998, adopted File Number 980292 directing the Commissioner of Public Works to assess the benefits and damages in the vacation of the alley in the block bounded by West Carpenter Avenue, West Layton Avenue, South 7th Street and South 10th Street in the 13th Aldermanic District of the City of Milwaukee; and
 
Whereas, The Commissioner of Public Works is required by law to assess benefits or damages for a street or alley vacation; and
 
Whereas, Said Council adopted File Number 980292 waiving benefit assessments for this vacation: now therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that although the Commissioner of Public Works has determined there to be benefits and damages accruing or arising from said vacation, the same shall not be levied.
