This resolution authorizes the sale of 0.07 acres of land to Milwaukee County for the reconstruction of County Trunk Highway "G", a/k/a North 43rd Street between West Mill Road and West Good Hope Road. Milwaukee County will purchase the property for $7,300, which was a negotiated settlement based on an independent appraisal.
BODY:
Whereas, Milwaukee County needs to acquire a portion of the City-owned land under the jurisdiction of the Milwaukee Board of School Directors for the reconstruction of North 43rd Street directly adjoining Hawthorne Elementary School; and
 
Whereas, Milwaukee County has offered to purchase said property, which is shown on the plan attached to and made a part of this Common Council File, in accordance with the provisions of Section 32.09, Wisconsin Statutes; and
 
Whereas, Negotiations between the City of Milwaukee and the Board of School Directors' representatives and the Milwaukee County consultant for this conveyance and the Temporary Limited Easements, have been satisfactorily completed; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the following property shall be conveyed to Milwaukee County by Warranty Deed for the amount stated and other valuable consideration:

Fee Land Acquisition - 2,818 square feet plus Temporary Limited Easement - 1,429 square feet
 
Consideration - $7,300 ($5,900 for land, $1,100 for lawn grass, $300 for Temporary Limited Easement)

Temporary Limited Easement - 63 square feet
 
Consideration - Mutual Benefit
 
; and, be it
 
Further Resolved, That Milwaukee County shall also be granted Temporary Limited Easements on a combined total of 1,492 square feet of City of Milwaukee property in the same project area; and, be it
 
Further Resolved, That the Commissioner of the Department of City Development, or the Commissioner's designee, is authorized and directed to sign appropriate Milwaukee County officials acquisition and easement documents; and, be it
 
Further Resolved, That the proper City officials are authorized and directed to perform such acts as may be required to consummate the conveyance of the subject property; and, be it
 
Further Resolved, That the proceeds of this sale be credited to Milwaukee Board of School Directors Construction Fund Account No. 2-10-3-000-000-299-255-000.
