Title
Substitute resolution authorizing a Maintenance Agreement between the City of Milwaukee and PNR 2, LLC for maintenance of a portion of the Granville Station ring roads, in the 9th Aldermanic District.
Analysis
This substitute resolution authorizes the proper City officials to enter into a Maintenance Agreement with PNR 2, LLC for the ring roads at the former Northridge Mall.
Body
Whereas, In August of 2013, PNR 2, LLC (“PNR 2”) purchased the former Boston Store, various outlots and the ring roads at the former Northridge Mall (“Mall”) from Tucker Development Corporation; and

Whereas, PNR 2 plans to redevelop the former Boston Store into a facility for Penzeys Spices and hopes to acquire the remainder of the Mall to further expand Penzeys’ operations at the Mall; and

Whereas, The redevelopment of the Mall is critical to the economic viability of the West Brown Deer Road corridor and the northwest side of the City of Milwaukee (“City”); and

Whereas, The Mall’s ring roads at 8180 West Brown Deer Road and 9233 North 76th Street (the “Ring Roads”) provide access to multiple private properties and operating businesses not controlled by PNR 2; and

Whereas, In support of PNR 2’s plans for the Mall, the City wishes to enter into a Maintenance Agreement, a copy of which is attached to this Common Council File, to provide basic maintenance of the Ring Roads, while the City further investigates the possibility of acquiring the Ring Roads as public right-of-way; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioners of City Development and Public Works are directed to enter into a Maintenance Agreement with PNR 2 for the maintenance of the Ring Roads, which agreement is in substantially the form that is part of this file with minor non-substantive revisions as may be approved by the Office of the City Attorney.
