Title
Resolution stating that South 35th Street between West Mitchell Street and West Greenfield Avenue reconstruction project meets the conditions of a “Constrained Environments” exception to Trans 75 Complete Street Guidelines.
Analysis
This resolution states that the South 35th Street reconstruction project meets the conditions of “Constrained Environments” exception as indicated in Chapter Trans 75 of the Wisconsin Administrative Code. The conditions to a “Constrained Environments” exception are met because adding marked bike lanes would result in excessive right of way acquisition. Adding marked bike lanes meeting design standards of the Wisconsin Department of Transportation’s Facilities Development Manual would require acquiring land from 59 properties. The Trans 75 “Constrained Environments” exception, under Complete Streets Guidelines requires a resolution by the local unit of government stating the project meets the conditions of the exception.
This resolution is necessary for the Wisconsin Department of Transportation to approve a proposed design of the South 35th Street reconstruction project that omits marked bike lanes between West Mitchell Street and West Greenfield Avenue.

Whereas, The Common Council of the City of Milwaukee adopted resolution file number 100021 on May 25, 2010 directing the Commissioner of Public Works to execute a State/Municipal Agreement with the Wisconsin Department of Transportation for the programming and reconstruction of South 35th Street between West Burnham Street and West Greenfield Avenue, including the project corridor; and
Whereas, South 35th Street is planned to be reconstructed in 2014; and
Whereas, In order to provide marked bike lanes between West Mitchell Street and West Greenfield Avenue, right of way would have to be acquired from 59 properties resulting in a Constrained Environment; and
