Title
Substitute resolution amending a cooperation agreement with the Wisconsin Energy Conservation Corporation relating to the Milwaukee Energy Efficiency Project (Me2 program).
Analysis
Common Council File Number 100007, adopted on July 27, 2010, authorized the Department of Administration to enter into a cooperation agreement with the Wisconsin Energy Conservation Corporation to implement the Milwaukee Energy Efficiency program, which is funded in part by a U.S. Department of Energy grant.
The existing cooperation agreement expires September 30, 2013, consistent with the former grant period of performance as defined by the Department of Energy. The U.S. Department of Energy has authorized a grant extension until November 1, 2014.
This resolution authorizes an amendment to the cooperation agreement with the Wisconsin Energy Conservation Corporation. The amendment extends the cooperation agreement until November 1, 2014. It also increases the City's role in program design and clarifies that after November 1, 2014, the City of Milwaukee shall retain control of any remaining loan loss reserve accounts or other "Evergreen funds."

Whereas, Common Council Resolution File Number 100007, adopted on July 27, 2010, authorized a cooperation agreement between the Wisconsin Energy Conservation Corporation and the City of Milwaukee regarding the Milwaukee Energy Efficiency Project, Me2 program, and Common Council Resolution File Numbers 100770, 110140, 110368, 111490 and 130410, adopted November 23, 2010, July 6, 2011, July 26, 2011, March 20, 2012, and July 23, 2013, respectively, authorized amendments to this agreement; and
Whereas, The existing cooperation agreement expires September 30, 2013, consistent with the former grant period of performance as defined by the U.S. Department of Energy, and the Department of Energy has authorized a grant extension until November 1, 2014; and
Whereas, The purpose of the ME2 program is to stimulate a sustainable market for energy efficiency in Milwaukee's residential, commercial and industrial building stock; and
Whereas, The Me2 program uses a grant from the U.S. Department of Energy to augment existing focus on energy programs with an innovative financing offer to address the high up-front costs of energy-efficiency upgrades, a community workforce agreement and marketing to attract new customers to the program; and
Whereas, Through August 30, 2013, the Me2 program had supported 2,219 home energy assessments, and upgraded 1,155 homes and 116 businesses with energy-efficiency improvements; and
Whereas, The Department of Administration--Office of Environmental Sustainability and Wisconsin Energy Conservation Corporation have competently administered the Me2 program to date; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Department of Administration is authorized to negotiate and enter into an amended cooperation agreement with the Wisconsin Energy Conservation Corporation, establishing the roles, responsibilities and allocation of resources between the Wisconsin Energy Conservation Corporation and the City, both as to general project oversight and the allocation and use of year 2014 grant extension award funds for the Me2 program, consistent with the objectives, terms and conditions of the U.S. Department of Energy grant award; and, be it
Further Resolved, That until the amended cooperation agreement is finalized, the City of Milwaukee may continue to charge the grant for eligible expenses from its original grant allocation of $1,433,400; and, be it
Further Resolved, That the Department of Administration is authorized to design and develop the Me2 program going forward, endeavoring to create a program model that is sustainable and effective and making necessary budget adjustments; and, be it
Further Resolved, That the Me2 program design may use revenues from participating customers, contractors or financial institutions to support the sustainability of the program.
