Analysis
This resolution states that the North 45th Street Bridge over the Menomonee River rehabilitation project meets the conditions of an Excessively Disproportionate Cost exception as indicated in Trans 75.04 of the Wisconsin Administrative Code Complete Street Guidelines. The condition to an Excessively Disproportionate Cost exception is met because adding marked bike lanes and wider sidewalks would result in excessive cost impacts. Adding marked bike lanes and sidewalks meeting design standards according to the Wisconsin Department of Transportation’s Facilities Development Manual would require a total bridge replacement. The Trans 75 Excessively Disproportionate Cost exception, under Complete Streets Guidelines requires a resolution by the local unit of government stating the project meets the conditions of the exception.

This resolution is necessary for the Wisconsin Department of Transportation to approve a proposed design of the North 45th Street Bridge over the Menomonee River that omits marked bike lanes and allows the use of sidewalk less than 6 feet wide.

Whereas, The Common Council of the City of Milwaukee adopted resolution file number 060882 on Nov 14, 2006 directing the Commissioner of Public Works to execute a State and Municipal Agreement with the Wisconsin Department of Transportation for the programming and rehabilitation of the North 45th Street Bridge over the Menomonee River; and

Whereas, North 45th Street over the Menomonee River is planned to be rehabilitated in 2014; and

Whereas, In order to provide marked bike lanes and a six-foot sidewalk on the bridge, the structure would have to be completely rebuilt rather than rehabilitated, resulting in exc...
