Title
Substitute resolution approving a law enforcement and security services agreement between the City of Milwaukee and the Forest County Potawatomi.
Analysis
This resolution approves a law enforcement and security services grant agreement between the Forest County Potawatomi Community (d/b/a Potawatomi Bingo Casino) and the City of Milwaukee for the provision of additional law enforcement services at the Casino. The term of the agreement is one year (9/30/2013 - 9/30/2014), with automatic one-year extensions unless the agreement is terminated in writing by one of the parties. The additional police services shall be funded through a grant of up to $100,000 from the Potawatomi to the City for this purpose.
Body
Whereas, The Forest County Potawatomi Community operates the Potawatomi Bingo Casino at 1721 W. Canal Street; and
Whereas, The Potawatomi Bingo Casino, which attracts over 6 million visitors annually, is a major entertainment venue in the city of Milwaukee; and
Whereas, The Potawatomi Bingo Casino has unique security needs that require additional police services; and
Whereas, The Forest County Potawatomi Community makes an annual payment of approximately $5.5 million to the City of Milwaukee under an Intergovernmental Cooperation Agreement between the Forest County Potawatomi and the City; and
Whereas, The Potawatomi Bingo Casino has proposed to provide the Milwaukee Police Department a grant of up to $100,000 annually for the assignment of on-premise police officers to the Casino on a regular basis, with the days and time of such assignment to be agreed to by the Chief of Police and the Potawatomi Bingo Casino; and
Whereas, The Chief of Police has indicated a willingness to provide special assignment of Milwaukee Police Department police officers in accordance with the terms and conditions of the "Law Enforcement and Security Services Grant Agreement Between the Forest County Potawatomi Community d/b/a Potawatomi Bingo Casino and the City of Milwaukee," a copy of which is attached to and made part of this Common Council file; and
Whereas, The initial term of this Agreement is September 30, 2013, to September 30, 2014, with automatic renewal for one-year terms until the Agreement is terminated by one of the parties upon written notice of termination; and
Whereas, The Common Council has adopted a policy under which the City will accept grants to provide additional police services to non-City entities; and
Whereas, The Common Council finds that the Potawatomi Bingo Casino proposal meets the policy's criteria; and
Whereas, The Forest County Potawatomi Community has approved the attached agreement and authorized its General Manager to execute the agreement on its behalf; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the attached "Law Enforcement and Security Services Grant Agreement Between the Forest County Potawatomi Community d/b/a Potawatomi Bingo Casino and the City of Milwaukee" is approved; and, be it
Further Resolved, That the Chief of Police is authorized to execute the Agreement on behalf of the Police Department and the City; and, be it
Further Resolved, That the City Comptroller is authorized to:
1. Commit funds within the Project/Grant Parent of the 2013 Special Revenue -Grant and Aid Projects, the following amounts for the project titled: "Law Enforcement and Security Services - Potawatomi Bingo Casino":

2. Create the necessary Grant and Aid Project/Grant and Project/Grant levels, and budget against these Project/Grant values the amount required under the grant agreement.
3. Establish the necessary City Share Project Values.

Further Resolved, That these funds are budgeted for the Milwaukee Police Department, which is authorized to expend the grant proceeds to provide law enforcement services to Potawatomi Bingo Casino in accordance with the approved Agreement.
