The common council recently amended the direct sellers ordinance to prohibit most direct sales from roadway medians or safety islands. The median sales prohibition applies to licensed direct sellers and to non-charitable direct sellers who are otherwise exempted from the direct sellers ordinance, such as agricultural sellers. The median sales prohibition does not apply to charitable organizations, which are partially exempted from the regulations of the direct sales ordinance. This ordinance prohibits charitable organizations from making direct sales from roadway medians or safety islands and deletes the median sales exemption for such organizations.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1. Section 95-1-3.5-a of the code is amended to read:
 
95-1. Direct Sellers.
 
3.5. CHARITABLE ORGANIZATIONS; PARTIAL EXEMPTIONS.
 
a. An employe, officer or agent of a charitable organization who engages in direct sales for or on behalf of said organization shall be subject to the provisions of [[sub.]] >>subs. 2.5,<< 9-a, b and d and sub. 12 and shall be exempt from all other provisions of this section, provided that all of the following requirements are met:
