-Analysis-

This resolution authorizes the Commissioner of Public Works to issue a permit to occupy the public right-of-way in North 21st Street, north of West Cherry Street in excess of that allowable under Section 115-10 of the Milwaukee Code of Ordinances.

BODY:
Whereas, A request has been received to formally vacate the cul- de-sac in North 21st Street, north of West Cherry Street; and

Whereas, The petitioner for the vacation is desirous of occupying a portion of the North 21st Street right-of-way prior to the finalization of the vacation process; and

Whereas, Section 115-10 of the Milwaukee Code of Ordinances specifies occupancy shall not extend into the roadway of a public way more than one- third the width of the roadway, and, in no case, more than 20 feet; and

Whereas, The petitioner of the vacation of North 21st Street has requested to occupy the entire roadway right-of-way of North 21st Street, which is in excess of that allowable by Code; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to issue a permit to American Apartment Management Company to occupy the entire roadway right-of-way of North 21st Street for the installation of a fence and gate approximately 150 feet north of West Cherry Street;...
