Analysis
This Resolution authorizes a settlement payment in three separate proceedings before the State of Wisconsin Department of Workforce Development Equal Rights Division, ERD Case No. CR201203316, ERD Case No. CR201203317, and EEOC Case No. 26G201300122C, in the amount of $10,000 and retroactive reinstatement of health insurance coverage at active employee premium rates to the date of termination of employment,

Whereas, The complainant, Laurie A.W. Guilbault, has filed claims against the City of Milwaukee alleging violations of the Wisconsin Family and Medical Leave Act and the Americans with Disabilities Act in three separate cases, ERD Case No. CR201203316, ERD Case No. CR201203317, and EEOC Case No. 26G201300122C; and

Whereas, the State of Wisconsin Department of Workforce Development, Equal Rights Division, found probable cause in each case that the City of Milwaukee had violated the complainant’s rights under the Wisconsin Family and Medical Leave Act and the Americans with Disabilities Act, and directed that all cases proceed to a hearing on the merits; and

Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle these claims; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the proper City officials be and are hereby authorized and directed to issue a City check in the amount of $10,000.00 payable to the order of Hawks, Quindel S.C. Trust Account, in full and final settlement of all monetary damages sought in this lawsuit, including reasonable attorney’s fees and costs, and retroactive reinstatement of health insurance coverage at active employee premium rates to the date of the complainant’s termination of employment, on receipt of a Release of Claims, approved as to form and execution by the City Attorney,...
