Resolution authorizing easements with Wisconsin Electric Power Company on the Milwaukee Fire Department property at 4927 West Fiebrantz Avenue and the Milwaukee Public Schools property at 4920 West Capitol Drive, in the 7th Aldermanic District.
Analysis
This resolution authorizes easements for underground electrical facilities across City-owned properties.
Body
Whereas, The Milwaukee Fire Department (“MFD”) is working with Wisconsin Electric Power Company, doing business as WE Energies, to upgrade electrical service to Engine No. 24 at 4927 West Fiebrantz Avenue; and

Whereas, To accommodate the service upgrade, WE Energies has requested an underground easement at Engine No. 24 and across the adjoining Milwaukee Public Schools (“MPS”) property at 4920 West Capitol Drive as illustrated in Exhibit A, a copy of which is attached to this Common Council File; and

Whereas, MFD and MPS have reviewed the proposed easements and determined that the easements will not interfere with use of the properties; and

Whereas, The City of Milwaukee (“City”) shall not require compensation for the easements because the easements provide improved electrical service to a municipal facility; and

Whereas, The easement on the portion of MPS school property at 4920 West Capitol Drive is expected to be approved by the Milwaukee Board of School Directors (“MBSD”) in the near future; and

Whereas, Legal title to MBSD real property is held in the name of the City, in trust for MBSD, and conveyance of MBSD property and property rights requires adoption of a resolution by the Common Council approving such action; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the easement with Wisconsin Electric Power Company, doing business as WE Energies, at the City-owned property at 4927 West Fiebrantz Avenue is approved; and, be it
