Analysis
This resolution approves an intergovernmental cooperation agreement between the City of Milwaukee and the Milwaukee County Department of Parks, Recreation and Culture relating to the creation and operation of an off-leash dog exercise area on City-owned land located at E. Lincoln Avenue and S. Bay Street. Under the agreement, the City will remit $50,000 from the Allis and Lincoln Play Area rehabilitation account to Milwaukee County in exchange for the County's development, operation and maintenance of the off-leash dog exercise area.
Body
Whereas, On April 9, 2013,the Common Council approved Common Council Resolution File Number 121650 relating to the development and operation of an off-leash dog exercise area on a portion of public right-of-way; and
Whereas, The resolution authorized City Attorney to draft an agreement between the City and Milwaukee County relating to the development and operation of an off-leash dog exercise area on the public-right-of way located at E. Lincoln Avenue and S. Bay Street, and
Whereas, The resolution also authorized, upon the approval of the off-leash dog exercise area agreement with Milwaukee County by the Common Council, the transfer of up to $50,000 from the Allis and Lincoln Play Area rehabilitation account for the development of the off-leash dog exercise area; and
Whereas, The City Attorney has submitted an intergovernmental cooperation agreement between the City of Milwaukee and the Milwaukee County Department of Parks, Recreation and Culture for approval by the Common Council, a copy of which is attached to this file; and
Whereas, The intergovernmental cooperation agreement is for a term of 10 years and may be extended for two additional 10-year terms with mutual consent; and
Whereas, Under this agreement, the City will remit $50,000 to Milwaukee County in exchange for the County's development, operation and maintenance of the off-leash dog exercise area on City-owned land located at E. Lincoln Avenue and S. Bay Street; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the attached intergovernmental agreement between the City of Milwaukee and the Milwaukee County Department of Parks, Recreation and Culture relating to the creation and operation of an off-leash dog exercise area on City-owned land located at E. Lincoln Avenue and S. Bay Street is approved; and, be it
Further Resolved, That the proper City officials are authorized to take the necessary actions to execute and implement this intergovernmental agreement.
