Title
Substitute resolution approving levying of assessments and construction of assessable public improvement projects at various locations and appropriating funds for these purposes with the City cost of these projects approved by this resolution is estimated to be $4,372,500 for a total estimated cost of $4,560,000.
Analysis
This resolution confirms the report of the Commissioner of Public Works, as modified by the Common Council Committee, on projects for which Public Hearings have been held. The resolution authorizes the levying of special assessments and directs the installation and construction of said public improvements. The City cost of these projects approved by this resolution is estimated to be $4,372,500. The total estimated cost of these projects is $4,560,000.

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions, determining it necessary and in the public interest to construct and levy special assessments for the following improvements:
1st Aldermanic District
Alley between W. Fairmount Ave., W. Lancaster Ave., N. Teutonia Ave., and N. 28th St. (ST212020107) File Number 090969: Concrete alley pavement reconstruction, replace some abutting walk or driveway approaches, grading, and storm drainage facilities where necessary. (Assessable Alley Paving Fund -- $13,900; Nonassessable Alley Paving Fund -- $60,000). The total estimated cost for this project including the requested amount is $79,000. This project is anticipated to be completed during the 2013-2014 construction season.
5th Aldermanic District
Alley between W. Nash St., W. Vienna Ave., N. 98th St., and N. 99th St. (ST212060112) File Number 091545: Concrete alley pavement reconstruction, replace some abutting walk or driveway approaches, grading, and storm drainage facilities where necessary. (Assessable Alley Paving Fund -- $20,400; Nonassessable Alley Paving Fund -- $55,000). The total estimated cost for this project including the requested amount is $80,000. This project is anticipated to be completed during the 2013-2014 construction season.

N. Richards St. at E. Clarke St. (ST211130185) File Number 130038: Install traffic circle. (Assessable Reconstruction Paving Fund -- $11,600; Nonassessable Reconstruction Paving Fund -- $20,000). The total estimated cost for this project including the requested amount is $30,000. This project is anticipated to be completed during the 2013-2014 construction season.
N. 4th St. - W. Concordia Ave. to W. Keefe Ave. (ST211130165): Install traffic calming speed hump(s). (Assessable Reconstruction Paving Fund -- $10,400; Nonassessable Reconstruction Paving Fund -- $22,000). The total estimated cost for this project including the requested amount is $32,000. This project is anticipated to be completed during the 2013-2014 construction season.

W. County Line Rd. - N. Swan Rd./N. 91st St. to 200 feet m/l east of N. 107th St. (Portions in the City of Mequon) (ST211200187) File Number 111472: Asphalt pavement with rural cross-section. (Assessable Reconstruction Paving Fund -- $33,000; Nonassessable Reconstruction Paving Fund -- $700,000). (ST214130104 Developer Funds -- City of Mequon $700,000). The total estimated cost for this project including the requested amount is $1,500,000. This project is anticipated to be completed during the 2013 construction season.
N. 124th St. - A point north of W. Brown Deer Rd. to a point south of W. County Line Rd. (Portions in the Village of Menomonee Falls) (ST211130120) File Number 111280: Concrete pavement with rural cross-section. (Assessable Reconstruction Paving Fund -- $4,600; Nonassessable Reconstruction Paving Fund -- $500,000). (ST214130103 - Developer Funds -- Village of Menomonee Falls -- $500,000). The total estimated cost for this project including the requested amount is $1,000,000. This project is anticipated to be completed during the 2013 construction season.

N. 72nd St. - W. Locust St. to W. Burleigh St. (ST211100107) File Number 091430: Pavement reconstruction and asphalt pavement resurfacing, replace all curb and gutter, replace sidewalk and driveway approaches where necessary, sodding (5-7 foot width of tree border area), and grading. Also included, are permeable sidewalk and special drainage facilities. (Assessable Reconstruction Paving Fund -- $31,000; Nonassessable Reconstruction Paving Fund -- $325,000). The total estimated cost for this project including the requested amount is $385,000. This project is anticipated to be completed during the 2013 construction season.

This project is anticipated to be completed during the 2013-2014 construction season.

This project is anticipated to be completed during the 2013-2014 construction season.

E. Clifford St. - S. Greeley St. to a point west of S. Greeley St. (ST210130102) File Number 121089: Construct new concrete alley-type pavement. (Assessable New Paving Fund -- $1,000; Nonassessable New Paving Fund -- $25,000). The total estimated cost for this project including the requested amount is $35,000. This project is anticipated to be completed during the 2013-2014 construction season.

Woodward St., (Northerly east-west leg) (ST212050103) File Number 031100: Concrete alley pavement reconstruction, replace some abutting walk or driveway approaches, grading, and storm drainage facilities where necessary. (Assessable Alley Paving Fund -- $22,700; Nonassessable Alley Paving Fund -- $65,000). The total estimated cost for this project including the requested amount is $96,000. This project is anticipated to be completed during the 2013-2014 construction season.

Whereas, Notices have been sent to all interested persons and public hearings held; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works' Report, as amended at said Public Hearing, is approved and the properties therein identified are benefited; and, be it
Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.0703 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
Further Resolved, That the proper departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessment in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
Further Resolved, That the City Comptroller is authorized to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts; and, be it
Further Resolved, That the projects do not involve any parcels of agricultural land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it
Further Resolved, That the Department of Public Works is authorized to use the funding as specified in the above description of work; and, be it
Further Resolved, That projects: Alley W. Fairmount Ave. (ST212020107), Alley W. Nash St. (ST212060112), N. Richards St. (ST211130185), N. 4th St. (ST211130165), N. 124th St. (ST211130120), N. 72nd St. (ST211100107), Alley W. Keefe Ave. (ST212030130), S. 30th St. (ST211020105), and Alley S. Lenox St. (ST212050103) will be billed after January 1, 2015, but not before 12 months after the project contract has been completed; and, be it
Further Resolved, That projects: W. County Line Rd. (ST211200187), S. 82nd St. (ST211060101), and Alley S. Honey Creek Dr. (ST212130111) will be billed after January 1, 2016, but not before 12 months after the project contract has been completed.
