Analysis

This resolution authorizes and directs the proper City Officers to execute partial sewer easement release, SER-1858B located in Lot 1 of CSM 8301, having Tax Key number 362-0508-000.

Body

Whereas, On June 24, 1968, the City of Milwaukee was granted sewer easement SE-1858B by Pabst Brewing Company for access and maintenance of the 42 inch combined sewer located on the vacated portion of the North 11^th Street right of way; and

Whereas, North 11^th Street is now a public right of way and due to the change in the width of the street right of way, a portion of said sewer easement is now partially located in Lot 1 of CSM 8301; and

Whereas, Said portion of sewer easement no longer serves the interest of the City of Milwaukee and should be partially released; now, therefore, be it

Resolved, by the Common Council of the City of Milwaukee, that the proper City officers, including the DPW Commissioner, are hereby authorized: (i) to accept Sewer Easement Release, SER-1858B, in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to sign the easement release and cause the same to be recorded in the Milwaukee County Register of Deeds Office.
