Title
Substitute resolution relative to acceptance and funding of a Wisconsin Department of Natural Resources Municipal Flood Control Grant allowing the City of Milwaukee to acquire and raze two residential properties and maintain the sites as stormwater management areas to prevent future flood related damages.
Analysis
This substitute resolution authorizes the Department of Public Works, Infrastructure Services Division to accept and fund a Municipal Flood Control Grant from the Wisconsin Department of Natural Resources (DNR) in the amount of $614,043, with a City of Milwaukee (City) share of $199,123 and a grantor share of $414,920. The grant would allow the City to appraise, acquire and raze two residential properties located at 5664 South 20th Street and 5710 South 20th Street and maintain the sites as stormwater management area to prevent future flood related damages. This substitute resolution also authorizes and directs the City Engineer to execute a Municipal Flood Control Grant Award Agreement between the City and the DNR.
Body
Whereas, Flood control is an important component of the City's storm water management policy; and
 
Whereas, Storm water flooding of residential properties poses serious health risks, saddles residents and other property owners with expensive cleanup, personal property replacement and  repair costs, and diminishes the quality of life for residents; and
 
Whereas, Storm water flooding of residential properties not only burdens the City's tight budget with the costs of additional civil emergency services and trash pickups, but it also reduces property values; and
 
Whereas, The DNR provides Municipal Flood Control Grants to help local governments minimize flooding and flood-related damages by acquiring, razing and creating stormwater management areas; and
 
Whereas, The City has applied (Common Council File Number 111393) for said grant funds to acquire and raze two residential properties at 5664 South 20th Street and 5710 South 20th Street that have suffered chronic stormwater flooding; and
 
Whereas, The DNR accepted the City's application and has awarded the City with grant funds; and
 
Whereas, The operation of this grant is from January, 2013 through January, 2015 and is estimated to cost $614,043, of which, a maximum grantor share not exceed $414,920 would be provided by the DNR, and the remainder $199,123 would be provided by the City; and
 
Whereas, Of the $414,920 to be provided by the grant, up to $331,800, can be used to purchase the properties with the remainder used for appraisal, demolition, moving costs and other costs associated with the purchase of the properties as shown on the spreadsheet attached to this substitute resolution, and is incorporated into this substitute resolution as though set forth in full; and
 
Whereas, The City intends to utilize the 2012 property assessment values as a cost basis to purchase the properties; and
 
Whereas,  5710 South 20th Street has been assessed by the City at $251,100 and 5664 South 20th Street has been assessed at $244,200 with a total assessed  value of $495,300; and
 
Whereas, Based on the 2012 assessment values and the DNR's offer of $331,800 towards the cost of purchasing the homes, the City would be responsible for the difference of $163,500; and
 
Whereas, The City would also be responsible for approximately $35,623 of additional costs which include cost of appraisals, relocation payments, structure removal costs and miscellaneous fees; and
 
Whereas, After the City acquires and razes the properties, the vacant land will be converted into a stormwater management area which will reduce future flood related problems in the area; and
 
Whereas, The cost of constructing the stormwater management area will be borne by the City; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the City Engineer is hereby authorized to accept such a grant without further Common Council approval unless the terms of the grant change as indicated in Common Council file 030712 (Grant Ordinance); and, be it
 
Further Resolved, That upon approval of this Agreement, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, Infrastructure Services Division which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
 
Further Resolved, That the City Engineer is authorized to execute a Grant Award Agreement between the City of Milwaukee and the DNR regarding said grant; and, be it
 
Further Resolved, That the City Engineer shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
 
Further Resolved, That the City Engineer on behalf of the City of Milwaukee be authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
