Title
Resolution relating to the development and operation of an off-leash dog exercise area on a portion of public right-of-way and authorizing the expenditure of up to $50,000 for this purpose.
Analysis
This resolution authorizes the City Attorney to draft an agreement between the City and Milwaukee County relating to the development and operation of an off-leash dog exercise area on the public-right-of way located at E. Lincoln Avenue and   S. Bay Street. The resolution also authorizes, upon the approval of the off-lease dog exercise area agreement by the Common Council, the transfer of up to $50,000 from the Allis and Lincoln Play Area rehabilitation account for the development of the off-leash dog exercise area.
Body
Whereas, There is no adequate open space in Bay View for dog owners to exercise their dogs off-leash; and  
 
Whereas, The underutilized  public right-of-way located immediately northwest of the intersection of E. Lincoln Avenue (grade-level portion) and S. Bay Street, underneath the Lincoln Avenue overpass above Bay Street could be developed into an off-leash dog exercise area; and
 
Whereas, The Milwaukee County Department of Parks, Recreation and Culture has expressed an interest into entering into a partnership with the City relating to the creation and operation of an off-leash dog exercise area on the public right-of-way located immediately northwest of the intersection of E. Lincoln Avenue (grade-level portion) and S. Bay Street, underneath the Lincoln Avenue overpass above Bay Street; and
 
Whereas, The Milwaukee County Department of Parks, Recreation and Culture has experience in the creation and operation of off-leash dog exercise areas, having opened its first off-leash dog exercise area in 1999 and currently operating  5 off-leash dog exercise areas throughout  the County; and
 
Whereas, A partnership between the City and the Milwaukee County Department of Parks, Recreation and Culture would benefit dog owners who would use the off-leash dog exercise area on the public right-of-way located immediately northwest of the intersection of E. Lincoln Avenue (grade-level portion) and S. Bay Street, underneath the Lincoln Avenue overpass above Bay Street; and
 
Whereas, The City's costs related to the development of an off-leash dog exercise area on the public right-of-way located immediately northwest of the intersection of E. Lincoln Avenue (grade-level portion) and S. Bay Street, underneath the Lincoln Avenue overpass above Bay Street, as an off-leash dog exercise area are estimated to be $50,000; and
 
Whereas, The City's 2013 Budget includes approximately $90,000 for the rehabilitation of the Allis and Lincoln Play Area in Bay View; and
 
Whereas, At this time, the development of an off-leash dog exercise area on the public right-of-way located at E. Lincoln Avenue and S. Bay Street would be of greater benefit to Bay View residents than the rehabilitation of the Allis and Lincoln play area; and
 
Whereas, A community fundraising effort is being planned to raise funds to offset the City's costs relating to the creation of the off-leash dog exercise area at E. Lincoln Avenue and S. Bay Street; and
 
Whereas, It is the intention of the community fund-raising effort that the funds raised will be used to restore funding for the for the rehabilitation of the Allis and Lincoln Play Area; now, therefore, be it     
 
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is authorized  to draft, with assistance from the Commissioner of Public Works, an agreement between the City and Milwaukee County relating to the development and operation of an off-leash dog exercise area on public right-of-way located immediately northwest of the intersection of E. Lincoln Avenue (grade-level portion) and S. Bay Street; and, be it
 
Further Resolved, That the agreement between the City and Milwaukee County relating to the development and operation of an off-leash dog exercise area on public right-of-way located immediately northwest of the intersection of E. Lincoln Avenue (grade-level portion) and S. Bay Street shall be submitted to the Common Council for review and approval; and, be it
 
Further Resolved, That upon the Common Council's approval of the agreement between the City and Milwaukee County, the City Comptroller is authorized to transfer up to $50,000 from Account Number 0321-5010-R999-BU110010523 "Allis Street Play Area", to Account Number 0321-5010-R999-BU110010530 for the development of the off-leash dog exercise area.
