Hampton Ave., Milwaukee, WI 53225 Mr. Gajevic testified to his dealings with the tavern, licensee, and operators of the tavern. He was involved in a drug trafficking operation since February 2012. As part of the operation, a December 3, 2012 search warrant was conducted at Larry's Fiesta in which there was a recovery of 150 grams of heroin and a semi automatic pistol in the tavern basement. The drug trafficking operation found that Leonard Givens was responsible for obtaining 350 grams of heroin from Chicago, storing the heroin in the tavern basement, using the vacant upstairs apartment to cut, divide, and package heroin, and redistributing the heroin to Milwaukee residents. Mr. Leonard Givens was arrested at the tavern, and Mr. Givens stated to be one-third owner of the tavern operation. Mr. Wigen told him that he has not been involved on a daily basis with the tavern since June 2012; leases to and collects rent from Leonard Givens, Nathan Givens, and Antonio Hopgood; did not want to renew the licenses. Mr. Wigen was issued a citation for engaging in a collusive agreement. The bar is also known as “Bar MME.” Leonard Givens has a bartender’s license. Mr. Hopgood has a Class B Manger’s and bartender’s licenses. Ms. Howard testified to the December 3, 2012 drug bust at Larry's Fiesta and to violent crimes, burglaries, and drug use in the district. Her officers have been routinely apprehending individuals using heroin at a nearby business’s parking lot and bathroom in an attempt to locate the source of the drug prior to the drug bust. The drug bust of December 3, 2012 was part of a federal investigation. She and her department were not aware any specific drug incidents at the tavern and were made aware later of the drug bust investigation. There have been increased burglaries within the last six weeks, which heroin has been linked to. Police squads have responded to Larry Fiesta as represented by the police report. The bar is also known as “Bar MME.” Ms. Saffold testified that the licensee of the tavern was sent a drug nuisance letter and did not take action or respond to police regarding the letter. The bar is also known as “Bar MME.” Mr. Pyles testified that heroin use has been problematic for his McDonald’s restaurant as outside individuals have locked themselves in the restaurant’s bathroom to use heroin. Heroin use by outside individuals also occurs on the restaurant’s parking lot. Heroin use on the restaurant’s premises did not originate from the business and have come from the area. His restaurant has been negatively affected by the heroin problem. Mr. Anderson testified to patronizing the tavern and feeling safe there. Ald. Willie Wade, 7th aldermanic district, testified that the managers of the tavern have severed ties with Leonard Givens, he as the alderman of the district was not made aware of heroin incident until very recently, and he is supportive of the renewal of licenses only if Mr. Wigen is the licensee and is more involved in the operations of the tavern. Based on the police report and testimony heard, Atty. DeSiato said that Mr. Wigen as the licensee has no control over operations, engaged in a collusive agreement, is not managing and overseeing tavern operations on a daily basis, and has stated that Leonard Givens was part of operation management to police. Mr. Wigen testified that he relinquished being an active member of bar a year ago, wants to now renew the licenses while the current managers gain more experience, will observe operations of the bar several times a week, and brought in Mr. Hopgood and Fraction into the business as managers. He added that Leonard Givens was an employee under the two managers and not part of the tavern management. Ald.
