Title
Resolution relating to Common Council approval of project design and final plans for any development to be constructed on City- or Redevelopment Authority-owned land conveyed to another owner by means of a land disposition report.
Analysis
This resolution stipulates that every Common Council resolution approving a land disposition report for the sale of Redevelopment Authority- or City-owned real estate shall explicitly include approval of the preliminary design and plans of the development proposed for the real estate.

This resolution also provides that no City department shall issue any permit for the construction of any improvement upon land that is the subject of a land disposition report if the plans submitted for such permit are inconsistent with the plans approved by the Common Council resolution approving the land disposition report.

Whereas, Section 66.1333(9)(a)1.d of the Wisconsin Statutes states that before a redevelopment authority may transfer, lease or sell any real property, “a report as to the terms, conditions and other material provisions of the transaction shall be submitted to the local legislative body, and the local legislative body shall approve the report prior to the authority proceeding with the disposition of the real property” ; and

Whereas, The Statutes are silent as to the specific information to be included in this report, which is known in Milwaukee as a “land disposition report”; and

Whereas, Neither the Statutes nor the Milwaukee Code of Ordinances give the Common Council explicit authority to review and approve the design and final plans for any development described in a land disposition report; and
