Analysis
This resolution authorizes the Commissioner of Public Works to issue a permit for the installation and maintenance of a sculpture in the triangle median located in the public right-of-way at the intersections of E. Lincoln Ave., S. Kinnickinnic Ave., and S. Howell Ave.
Body
 
Whereas,  The intersection of Howell, Kinnickinnic and Lincoln Avenues has been redesigned and completed into a single triangular traffic island which is to house a Milwaukee County Transit System bus shelter; and
 
Whereas, Commitments to finance a sculpture which will incorporate a bus shelter into the design have been made by Milwaukee Arts Board, the City's Office of Environmental Sustainability and private citizens; and
 
Whereas, A Bay View Stop Design Competition Committee was formed that included representatives from the City of Milwaukee, Milwaukee County Transit System, Milwaukee Arts Board, Kinnickinnic Avenue Business Improvement District BID #44, Bay View residents and business owners and the Alderman of the 14th District of the City of Milwaukee; and
 
Whereas, A competition was held to design a sculpture for the intersection; and
 
Whereas, The Competition Committee has selected as its winner a design submitted by an ex-Bay View resident, Roman Montoto, an Associate Professor of Architecture at he University of Idaho; and
 
Whereas, The installation of this sculpture shall be an iconic art project for both the Bay View neighborhood and the City of Milwaukee; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized to issue a permit for the installation and maintenance of a sculpture in the triangle median located in the public right-of-way at the intersections of E. Lincoln Ave., S. Kinnickinnic Ave., and S. Howell Ave; and, be it
 
Further Resolved, That before issuing a permit, the Commissioner shall review the specific proposed plans for the sculpture to ensure there are no adverse impacts upon public safety and public utilities, and that the plans be revised to mitigate any adverse impacts; and, be it
 
Further Resolved, That the permit for the installation of the sculpture shall be premised upon the following:
 
1.  The Kinnickinnic Avenue Business Improvement District (BID #44) shall install and maintain the sculpture at its own expense.
2.  Any cost to the City of Milwaukee shall be funded by BID #44 or the sculpture project budget.
3.  BID #44 shall hold the City of Milwaukee and its agents harmless and shall accept all responsibility for any liability that may arise through implementation of the rights granted through the permit.
4.  BID #44 shall remove, at its own expense, the sculpture when so ordered for reasons of public necessity and shall restore the site to its former condition in conformity with standards established by the Commissioner of Public Works.
