Title

Analysis

This Resolution authorizes the City, on behalf of the Milwaukee Board of School Directors, the school district organized under Chapter 119 of the Wisconsin Statutes ("MBSD") to convey real property formerly used for school purposes and located at 4601 N. 84^th Street, (Morse), Milwaukee, Wisconsin.

Body

Whereas, the Hmong American Peace Academy ("HAPA") operates a non-instrumentality charter school serving grades K4 tough 8 authorized by the Milwaukee Board of School Directors ("MBSD"); and

Whereas, HAPA leases the former Morse Middle School at 4601 N. 84^th Street ("the Property") from MBSD, but desires to purchase the Property; and

Whereas, MBSD authorized the sale of the Property on November 17, 2011 upon terms and conditions set forth in the Term Sheet associated with this Common Council file; and

Whereas, Legal title to MBSD real property is held in the name of the City of Milwaukee, in trust for MBSD, and conveyance of surplus MBSD property requires adoption of a resolution by the Common Council approving such conveyance; and

Whereas, The Common Council desires to approve the conveyance of the Property upon the terms outlined in the Term Sheet; now, therefore, be it

Resolved, By the Common Council that the conveyance of the Property upon the terms and conditions outlined in the Term Sheet, is hereby approved and the proper City officers, or their designees are hereby authorized and directed to execute the necessary instruments of conveyance.

Further Resolved, That the net sale proceeds shall be provided to Milwaukee Public Schools.
