Title
Resolution authorizing the Department of Public Works and the City Comptroller to execute an agreement between Milwaukee County, the City of Milwaukee and the City of Oak Creek for the installation, operation and maintenance of street lighting facilities on East College Avenue from South Howell Avenue to South Pennsylvania Avenue.
Analysis
This Resolution authorizes the Commissioner of Public Works and City Comptroller to enter into an agreement with Milwaukee County and the City of Oak Creek for the installation, operation and maintenance of street lighting facilities on East College Avenue from South Howell Avenue to South Pennsylvania Avenue.  Under this agreement, Milwaukee County would install new street lighting facilities on this roadway, excluding the airport tunnel, and will fund 100% of the cost of these improvements utilizing State and Federal Highway Aid provided in conjunction with the paving of that roadway.  The Cities of Milwaukee and Oak Creek would provide for the design of the lighting system to be installed, and assume ownership as well as the responsibility for the operation and maintenance of the new street lighting.
Body
Whereas, The segment of East College Avenue from South Howell Avenue to South Pennsylvania Avenue (County Trunk Highway ZZ) is under the maintenance jurisdiction of Milwaukee County; and  
 
Whereas,  This segment of East College Avenue lies on the border between the City of Milwaukee and the City of Oak Creek; and
 
Whereas, The City of Milwaukee currently provides street lighting on only a portion of the north side of East College Avenue east of South Howell Avenue, while the south side of the roadway in the City of Oak Creek remains unlit; and
 
Whereas;  East College Avenue is currently being reconstructed by Milwaukee County between South Howell Avenue and South Pennsylvania Avenue using State and Federal Aid, with Milwaukee County providing the local share of costs; and
 
Whereas, Milwaukee County has proposed to provide for the improvement of street lighting on the entire segment of East College Avenue between South Howell Avenue and South Pennsylvania Avenue in conjunction with the State and Federal Aid paving of that roadway to provide for increased safety of pedestrians, bicyclists and motorists on that roadway; and
 
Whereas, Milwaukee County has secured all necessary approvals to install street lighting facilities utilizing State and Federal Highway Aid and County local matching funds in conjunction with the paving of this section of East College Avenue; and
 
Whereas, Milwaukee County has prepared an agreement between the County, the City of Oak Creek and the City of Milwaukee for the design, construction, ownership, operation and maintenance responsibilities for the new permanent street lighting facilities on East College Avenue from South Howell Avenue to South Pennsylvania Avenue, excluding the airport tunnel; and
 
Whereas, Under this agreement, the City of Milwaukee and the City of Oak Creek will share ownership of the new street lighting on East College Avenue from South Howell Avenue to South Pennsylvania Avenue., excluding the airport tunnel; and
 
Whereas, The agreement provides that the City of Milwaukee will assume responsibility for the design, operation,  maintenance, and all energy costs of the new street lighting on East College Avenue from South Howell Avenue east to the airport tunnel; and
 
Whereas, The agreement also provides that the City of Oak Creek will assume responsibility for the design, operation,  maintenance, and all energy costs of the new street lighting on East College Avenue from South Pennsylvania Avenue west to the airport tunnel; and
 
Whereas, If the construction bid amount exceeds the County's estimate of $300,000 for the cost of construction of these street lighting improvements by 10% or more, prior authorization from the City of Milwaukee as well as Milwaukee County and the City of Oak Creek will be required to award of any contract for construction of the proposed street lighting improvements; and
 
Whereas, Any additional construction costs  that exceed the cost estimate for the street lighting installation will be shared equally by the City of Milwaukee and the City of Oak Creek; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and the City Comptroller are authorized to execute an Agreement between Milwaukee County, the City of Milwaukee and the City of Oak Creek for the ownership, design, construction, operation and maintenance of the new permanent street lighting facilities proposed to be installed as part of the East College Avenue reconstruction project from South Howell Avenue to South Pennsylvania Avenue, a copy of which is attached to this resolution, and is incorporated into this resolution by reference as though set forth in full, and be it
 
Further Resolved, That upon the approval of this Agreement, the Commissioner of Public Works is authorized to provide construction plans for the proposed street lighting improvements on East College Avenue from South Howell Avenue east to the airport tunnel, and to assume the responsibility for operation and maintenance, as well as electrical energy costs, for these improvements.
