Title
Resolution directing the Department of Administration - Procurement Services Division to insert an indemnification clause in a personal services contract between the office of the Comptroller and Michael J. Daun.
Analysis
Michael J. Daun retired as Deputy Comptroller on April 13, 2012.  The office of the Comptroller has requested his services to assist in the transition of the new Comptroller into office.  Mr. Daun has requested indemnification similar to that provided to regular City employees as part of his personal services contract with the Comptroller's Office.  This resolution directs that the appropriate indemnification clause be inserted into Mr. Daun's contract.

Whereas, Michael J. Daun retired as Deputy Comptroller on April 13, 2012; and
 
Whereas, The office of the Comptroller desires to retain the services of Mr. Daun for a brief period to assist in the new Comptroller's transition into office; and
 
Whereas, Mr. Daun has requested indemnification similar to that provided to regular employees; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Department of Administration - Procurement Services Division is directed to insert an indemnification clause in a personal services contract between the office of the Comptroller and Michael J. Daun to read as follows:
 
"The CONTRACTOR shall not be required to provide liability insurance during the term of this Contract or any extension thereof.  The CITY shall indemnify and hold harmless the CONTRACTOR for any claims or liability that may arise as the result of the CONTRACTOR performing services under this Contract."
