Resolution appropriating the sum of $225,000 from the contingent fund to reimburse the Employes' Retirement System (ERS) for outside counsel costs as a result of the ERS process documentation project. (City Attorney)
ANLS:
The ERS has undertaken a process documentation project to document the processes involved in the administration of the pension system. Arthur Andersen, the project consultant, has estimated that approximately 930 hours of city attorney time over approximately a ten-month period will be necessary in order to implement the project. The city attorney has written the executive director of the ERS stating that his staff cannot meet the time commitment required by the project. The city attorney recommended, and the Annuity and Pension Board approved, that the city attorney hire an outside law firm to be retained for approximately 1,500 hours at $150 per hour for a total cost of $225,000. This resolution would reimburse the ERS for the costs associated with retention of the outside law firm by the city attorney.
BODY:
Whereas, The ERS has undertaken a process documentation project with the approval of the common council; and

Whereas, The project consultant has estimated that the implementation of the project will require 930 hours of city attorney time over approximately a 10-month period; and

Whereas, The city attorney is unable to make the time commitment required by the project; and

Whereas, The city attorney has recommended, and the Annuity and Pension Board of the ERS has approved, the city attorney's retention of an outside law firm to assist the city attorney in meeting the requirements for implementation of the project; now, therefore, be it

Resolved, That the office of the city attorney is hereby authorized and directed to engage outside counsel and to authorize the ERS to pay legal fees based upon invoices approved by the city attorney; and, be it
