Analysis

 

Body

WHEREAS, on May 15, 2002 the Housing Authority entered into a Lease Agreement with Telecorp Realty, L.L.C., a Delaware Limited Liability Company (“Lessee”) to allow Lessee to attach antennas and other telecommunications equipment on the roof of Lincoln Court at 2325 S. Howell Avenue in the City of Milwaukee; and

 

WHEREAS, A Memorandum of Lease was recorded with the Milwaukee County Register of Deeds on October 28, 2002, as Document No. 8374605, with an incorrect legal description which included certain lands that had previously been conveyed by the Housing Authority to a third party; and

 

WHEREAS, a new Lease Agreement was entered into on November 20, 2013 between the Housing Authority and T-Mobile Central LLC (a successor to Lessee); and

 

WHEREAS, the Housing Authority desires to enter into a new Memorandum of Lease to reference and give notice of the new 2013 Lease Agreement and to terminate the Memorandum of Lease which was executed and recorded in 2002; and

 

WHEREAS, a copy of the new Memorandum of Lease, with the correct legal description for Lincoln Court, is on file with the Secretary.

 

NOW, THEREFORE, BE IT RESOLVED, by the Housing Authority of the City of Milwaukee that the new Memorandum of Lease, in the form on file with the Secretary, is hereby approved; and be it

 

FURTHER RESOLVED, that the Interim Secretary-Executive Director is authorized and directed to execute and deliver the new Memorandum of LEASE, with such minor non-substantive revisions as may be approved by the Interim Secretary-Executive Director.
