TITLE
Substitute resolution approving an exception to the normal City of Milwaukee requirement that sidewalks be developed in conjunction with the construction of all new streets.
ANALYSIS
Section 113-12.5 of the City of Milwaukee Code of Ordinances requires that sidewalks be installed on both sides of any new street to be constructed in the city.  The Code goes on to say that the Common Council may waive or defer this requirement.  A developer is proposing a new single-family home subdivision in the vicinity of West Brown Deer Road and North116th Street.  The developer has requested that the requirement for sidewalks in the proposed subdivision be waived.  This resolution waives the sidewalk requirement.
BODY
Whereas, Backus Milwaukee LLC, a developer, has proposed development of a single-family residential subdivision in the area generally located between West Brown Deer Road and Dretzka Park at North 116th Street; and
 
Whereas, This subdivision, to be known as Tara Vista Estates, would include construction of several new public streets; and
 
Whereas, Section 113-12.5 of the City of Milwaukee Code of Ordinances requires that sidewalks be installed on both sides of any new street constructed in the city; and
 
Whereas, This section of code also provides that the Common Council may waive the sidewalk requirement on a case-by-case basis; and
 
Whereas, The developer has requested that the sidewalk requirement be waived for his project due to the cost of sidewalk construction and his desire to create a suburban feel to the subdivision; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the requirements of Section 113-12.5 pertaining to sidewalk installation in conjunction with new City streets are hereby waived for the proposed Tara Vista Estates subdivision.
