Analysis
This resolution removes deed restrictions imposed by the City of Milwaukee that prohibits division of said property and construction of any principal buildings on said property.
Body
Whereas, Pursuant to Common Council File No. 950825, the City of Milwaukee conveyed to Central City Catholic Parishes (now known as Capital Christian Center, Inc.) by a Quit Claim Deed dated November 29, 1995, two tax-deed vacant lots at 2417-19 and 2423 North 36th Street that adjoined the parish property at 2474 North 37th Street; and
 
Whereas, The deed of conveyance contained restrictions that the land conveyed therein "shall be joined with the Grantee's adjoining property so as to create a single parcel to be used as a unit; that said combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee; that the land herein conveyed shall be used as open space and no principal buildings may be erected thereon"; and
 
Whereas, Removal of the deed restrictions is required to allow the new property owner to expand the church and separate the school parcel to allow for future sale; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restrictions contained in the deed dated November 29, 1995, to allow for development and subdivision of said property.
