Analysis
This ordinance:
1. Amends and creates various definitions for clarity and consistency with city and state code.
2. Repeals unused and outdated definitions.
3. Reorganizes general administrative provisions for clarity and consistency.
4. Reorganizes provisions relating to temporary food dealers.
5. Repeals provisions relating to seasonal food dealers, to be consistent with state law.
6. Creates a new subchapter dedicated to licensing procedure. Currently, licensing procedures are located throughout the chapter and do not sufficiently reference the standard licensing procedures set forth in chapter 85.
7. Removes the distinctions among food peddler license types. Currently, licenses are issued in three different types: pushed, pedaled or pulled vehicles; motorized vehicles; and carried containers.
8. Repeals provisions relating to signage and unique identifiers for food peddlers. A food peddler is still required to display a license.
9. Repeals a provision allowing soda water to be sold only in single-service bottles, cups or aluminum cans.
10. Provides that specifications for time-lapse security cameras and specifications for storage of security footage be approved by the chief of police. Current specifications are too specific and outdated.
11. Repeals provisions relating to the food license review board.
12. Expands the prohibition of the sale of food items from medians to include all items sold from vehicles.
13. Amends the times at which the sale of items from parked vehicles is prohibited to:
a. Between the hours of 3 a.m. and 6 a.m. Monday through Frida...
