Whereas, The plaintiff, Yankee Hill Housing Partners, Ltd., filed a lawsuit against the City of Milwaukee; and
Whereas, The Circuit Court of Milwaukee County ruled in the City's favor but the Court of Appeals ruled against the City and ordered it to pay a judgment in the amount of $196,274.89 plus interest and costs; and
Whereas, The negotiated total of interest and costs owed to the plaintiff is $247,400.70 if paid by January 31, 2015; and
Whereas, The plaintiff has agreed to settle this lawsuit in the amount of $247,400.70; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay this judgment; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials be and are hereby authorized and directed to issue a City check in the amount of $247,400.70 payable to the order of Trust Account of Foley and Lardner, LLP in full and final settlement of all monetary damages sought in this lawsuit against the City and its officers, including statutory fees and costs, on receipt of a Release of Claims, approved as to form and execution by the City Attorney, said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300.
