Resolution approving a Landscape Maintenance Agreement between the City of Milwaukee and the Wal-Mart Corporation regarding a traffic diversion improvement to be constructed in North Servite Drive immediately south of the main entrance to the Wal-Mart store located at 8700 North Servite Drive.
Analysis
This resolution authorizes the Commissioner of Public Works to execute a Landscape Maintenance Agreement between the City of Milwaukee and the Wal-Mart Corporation. The agreement pertains to a new traffic diversion facility to be constructed in North Servite Drive to prevent store-related traffic exiting the parking lot from turning south on Servite Drive. Under the terms of the agreement, the City would construct the traffic diverter structure and Wal-Mart would install and maintain landscaping thereon.
Body
Whereas, The City of Milwaukee plans to construct a traffic diversion facility in Servite Drive near the entrance to the Wal-Mart store located at 8700 North Servite Drive; and

Whereas, The Wal-Mart Corporation is willing to install and maintain landscaping in the new traffic diverter; and

Whereas, Wal-Mart’s willingness to make and maintain these improvements is likely to mean a higher quality landscape amenity than the City could afford; and

Whereas, A plan for the landscape improvements will be prepared in conjunction with the Department of Public Works’ Forestry Section; and

Whereas, A Landscape Maintenance Agreement between Wal-Mart and the City has been drafted and is attached to the file; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to enter into the Landscape Maintenance Agreement; and, be it

Further Resolved, That the Commissioner may make minor, non-substantive changes in the agreement prior to signing it; and, be it
