This substitute resolution removes a deed restriction from said lot to allow for its sale to the other adjoining property owner.
BODY:
Whereas, The City of Milwaukee conveyed to Cha Lue Xiong and Mee K. Xiong the south half of the vacant, tax deed lot located at 1514-16 North 34th Street via a deed dated June 25, 1996 pursuant to Common Council File No. 951631; and
 
Whereas, Said deed of conveyance contained a restriction that the land conveyed therein "shall be joined with the Grantee's adjoining property so as to create a single parcel to be used as a unit; and that said combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee"; and
 
Whereas, Said lot was split and sold to both adjoining owners, Mr. and Mrs. Xiong and Carolyn Luckett to be joined with each of their properties at 1510 North 34th Street and 1518-20 North 34th Street, respectively; and
 
Whereas, Mr. and Mrs. Xiong are entertaining an Offer to Purchase their portion of said lot from the other adjoining owner, Ms. Luckett; and
 
Whereas, Removal of the deed restriction will allow for such sale; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restriction contained in the deed dated June 25, 1996, to allow for the sale of the south half of said lot to Ms. Luckett.
