Title
Substitute resolution relating to the removal of brick and stone pavers from the public way.

Analysis

Currently, the majority of Department of Public Works contracts for public works construction projects where brick or stone pavers are removed contain provisions that allow the contractor to own and dispose of the pavers. This substitute resolution directs the Department of Public Works to include language in all future public works contracts where brick and stone pavers are salvageable to retain ownership of the brick and stone pavers. The resolution also directs the Department of Public Works to evaluate the usefulness of brick and stone pavers it collects from construction projects and to salvage and store the pavers it deems useful for use by City departments in future projects or dispose of the pavers as surplus items through the Department of Administration-Business Operations Division.

Whereas, The majority of Department of Public Works contracts for public works projects where brick or stone pavers are removed during Department of Public Works’ construction projects contain provisions that allow the contractor to own and dispose of the pavers; and

Whereas, It would be beneficial to the city to have the Department of Public Works collect and store salvageable brick and stone pavers that are removed from projects during Department of Public Works’ construction projects for use in future public works projects or to dispose of the pavers as surplus items through the Department of Administration-Business Operations Division; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, the Department of Public Works is directed to include language in all future public works contracts where brick and stone pavers are salvageable from the public way to retain ownership and collect all brick and stone pavers; and, be it
