(Expired 5/9/2024) The applicant was present along with Atty. David Halbrooks and Mohammed Otallah. Individuals in objection: Ms. Hegarty (MHD) said that they really wanted to make sure to bring before the Council’s the whole point of having a license and operating without a valid license. She added that within the last year, this operator have been discovered operating without a valid license, that orders to cease operations have been issued and that the operator have chosen to continue operations 8 times after (within a month). She also said that the inspector explained them the process, that they were not able to operate unless they have a valid license and asked to keep the "closed" placard up but that they continued to remove it each time. She said that she wanted to bring this conversation before Council to make sure that they understand the requirement for a license and that they cannot operate unless they have a valid one. Ald. Zamarripa asked if they received citations. Ms. Hegarty said that they were cited for operating without a license and removal of the placard each time. Ald. Zamarripa asked if they have paid the fines. Ms. Hegarty said that out of 18 citations all but 4 were dropped, 2 were paid and that 2 seems to be pending. Atty. Halbrooks said that this location was run by these two applicants and that they wanted to continue after the father stepped out. He added that an accountant decided to set up a new LLC which it led to an entire new administrative process for a place that never had violations or health issues. He added that there was an incident where a semi vehicle hit the light pole knocking down the business sign which it needed to be replaced in order to complete the electrical inspections required by DNS. He said that the applicants kept on opening the store in a desperate measure to get the $5K needed to replace the sign and to stay on business. He also said that the HD is correct, that his clients received a bunch of citations that were addressed at the municipal court and that the judge used his discretion to drop some of them. He added that his clients plead guilty for 4 of them and that they are in a payment plan. He said that the license lapsed because the mailbox was stolen and they did not receive the renewal form. He asked the committee to make a different decision and to grant the license with a warning letter instead. Mr. Cooney explained that the MHD objection is about the fact that they were asked to cease operations after May 9th and that they chose to operate after. Ald. Spiker asked the applicant if he reached out to the alderwoman’s office after having the electrical issues. The applicant said that they did not. Ald. Spiker said that it was very disrespectful to operate without a license after receiving the first citation and despite the fact that the provisional license was denied. He added that the applicant took his sweet time by reopening the business, getting caught, having citations being drop down to 4 and being in a payment plan for 4 because he needed to do what he did but that he also need to be licensed by the City to legally operate. He added that the applicant showed a disdain for the process. Ald. Zamarripa asked how many times the applicant removed the placard. Ms. Hegarty said that it was 10 times. Ald. Burgelis asked for the dates when they were asked to cease operations. Ms. Hegarty said that the dates were May 10, 12, 13, 15, 17, 20, 21, 25, 29 and June 1. Atty. Halbrooks said that many citations were written on the same day. Ms. Hegarty explained that Atty. Halbrooks is right in the way that they received the citations at once but it is because they were written on the same day and take a significant amount of time to write one. She added that each time that the inspector talked to the applicant, he explained that they were going to receive a citation for each violation and that the applicant acknowledged to the inspector that it was his choice to reopen. She also said that there is a photo to support each of the observations. The applicant said that his intention was not to override the MHD orders but that they were desperate to stay in business. Ald. Spiker said that it was clearly his intention to override the MHD orders. There were no neighbors present to testify. Terri Williams said that Ald. Dimitrijevic recommends approval with a warning letter. Ald. Burgelis said that the applicant knew that he needed a license to operate anyways and that the applicant made the conscious decision to reopen his business without a license. Ald. Spiker moved approval with a 15 day suspension based upon the preponderance of the evidence in the applicant, aldermanic and MHD testimony and the lack of compliance on following the MHD orders and the failure to comply to with the approved plan of operations. (Expires 8/2/2024) The applicant was present along with Atty. Bobot. Atty. Bobot said that the business always notifies the police and that they are very cooperative. He asked the committee to take a look to a couple of items where pepper spray was used effectively, that his client has professional security (Black Knight Patrol) and multiple surveillance cameras. Individuals also present: Ald. Zamarripa wanted to clarify that this business is now part of her district and asked Ald. Perez to stay in order to make any comments. She added that she is concerned with item 14 and asked the applicant if he knows about having gang members patronizing his establishment. Atty. Bobot said that his client called the police but that he decided to wait for the police to take any action and not to throw them out to avoid any future conflict. He added that this is an isolated incident and his client does not cater gang members. Individuals in opposition: Lisa Washington - 1241 W National #5 – said that she agrees with everything on the police report. She added that she has called the police several times for shootings, patrons burning wheels and the loud noise from the bass of that bar. She added that on June 9th, there was a party on the patio of the bar and that she knows that the patio is not licensed. She said that for this matter she started to call the police at 5pm and that MPD showed up around 2am. Mr. Cooney said that they need to add Patio to the application. Ald. Perez asked what the capacity for this location is. Atty. Bobot said that it is 65. Ald. Perez asked the neighbor how often she hears the noise. Ms. Washington said that it is pretty consistent from Thursdays to Sundays. Atty. Bobot said that the music does not come from the patio neither from this establishment and that he will make sure that the neighbor won’t have the issue again. Ald. Zamarripa asked the witness if she has video evidence about the patio is being used. Ms. Washington said that she has it. Ald. Zamarripa moved to hold the application to the call the chair to review the video. Ald. Spiker asked the applicant if he had used the patio before. The applicant said that he used the patio once on between June 8th-10th to celebrate his birthday and that his business was closed. He added that he live in the apartment upstairs and that he uses the patio to grill. Ald. Spiker asked Ms. Washington if she remembers the date when the patio was used. Ms. Washington said that the date was June 9th. Ald. Spiker said that both testimonies squared up. Ald. Zamarripa moved to hold the application to the call of the chair. There were no objections. Minutes note: 12 SALAZAR, Francisco, Food Dealer and Food Peddler License Renewal Applications for "Taqueria El Cabrito" at 1100 S 11th St. (Expired 5/30/2024) Francisco Salazar appeared along with Leonardo Salazar as interpreter. The applicant said that he was accused but he is innocent and that he did not go to trial because the prosecutors did not find evidence and that he accepted the offer. Individuals also present: Ald. Spiker asked the applicant is he pled. No response. Ald. Spiker said that one can be on probation for something unless one is found guilty or pled. Ald. Spiker asked what would be the applicant’s roll at this food dealer and food peddler businesses. The applicant said that he cooks, that he is making sure that they have everything what they need to operate the business and works at the office as well. Ald. Spiker asked if the applicant has the final say on hiring/firing decisions. The applicant answered “yes”. Ald. Spiker is he has underage employees. The applicant answered “no”. Ald. Spiker said that he is all for second chances, people have to eat, take care of their families but that in this instance it’s different because there are families and children coming to the restaurant. Mr. Cooney said that the letter from DOC says that the applicant is not in violation of his probation with this license. Ald. Burgelis asked the applicant if having contact with minors is a violation of his parole. The applicant answered that it is but that he is not in contact with minors because he is working in the kitchen. He added that his parole agent told him that he can work on the back of the restaurant and that he cannot be at the dining area where the families/customers are. Ald. Burgelis asked the applicant if he would be willing to amend his plan of operations to restrict people under the age of 18 from entering his business. The applicant said that he does not understand why he is being asked for that if he is not at the front/dining area and that his wife is in charge of the business. Ald. Burgelis said that he is not comfortable renewing the licenses without that restriction and that he is talking from a personal experience being a restaurateur before. Sgt. Velasquez said that Officer Monreal got some clarification on the case and that the applicant pled no contest to neglecting a child charge and that the provisions are no contact with the accuser and the accuser’s mother and no unsupervised contact with anyone under age of 18 years old except for a family member. Ald. Perez said that for the context, this was a pretty egregious charge and that the committee keep it open waiting for disposition, that we know what the final disposition is and that all members have raised great points of concerns. He recommended amending the license that the applicant can’t be on the floor and that he was told by the City Attorney that this would be difficult to defend for a nonrenewal or suspension. The applicant said that he is willing restricting his access to the dining/common area. Ald. Perez said that he was also advised to keep the item open in case of any violation within the renewal period, both can be taken into account. Ald. Westmoreland moved to amend the application indicating that the applicant cannot be present at the front of the house and common areas (except for kitchen and office). Ald. Spiker said that the plan of operation does not reflects his testimony about not hiring anyone under the age of 18 years which defeats the purpose of the previous amendment and suggested to include this restriction on the plan as well. The applicant agreed. Ald. Spiker moved to amend the plan of operation by adding the restriction of not hiring anyone under 18 years of age. There were no objections. Ald. Spiker asked the applicant if he is willing to amend the plan of operation by restricting the access to anyone under 18 years of age to the kitchen, office and employees bathroom to prevent any contact with him. The applicant agreed. Ald. Perez that he does not mind to clean up the restrictions through amendments and that he also wants to make it part of the record the advice given by the City Attorney for the discipline options and that it would be difficult defending a suspension or a nonrenewal. He added that we can hold it to clean it up before the Common Council. Atty. Gresham said that a nonrenewal on second cycle is tougher to defend consistent with the evidence presented to the committee the first time around. Ald. Perez wanted to clarify that the item was not considered last year, that it was held open waiting for disposition and that he agreed to hold the application. (Expires 8/2/2024) The applicant was present along with Atty. Brian Randall. He added that there basically three categories of issues on the police report: auto thefts, domestic and custody disputes happening with extended stay guests at the hotel and mental health/social issues that are linked to the hotel because the people who make the complaints are also staying at the hotel but none of the issues are related to the business operations. There were no neighbors present to testify. Individuals also present: The applicant said that the hotel is fully staffed and that there is a 24hr service desk. Ald. Spiker asked if the 24hr employees are trained or licensed. The applicant said that they are not licensed but trained. Atty. Randall said that they have met with Ald. Taylor and that they have come up with a plan of operations that has been added to the record (and went through each item with the committee). The applicant said that they operate a business with procedures and that speak volumes how they treat their guests. Ald. Taylor said that she will make sure that they practice security and that the applicant addresses each of her concerns with the presented supplemental plan. She added that she recommends approval with a warning letter for the number of items on the police report and that this business brings value to the district. Ald. Spiker asked the applicant to provide resources to their guests like signage for domestic abuse, human trafficking, etc. Ald. Pratt moved approval with a warning letter. There were no objections.
