The applicant said that he believes it was in the leg.
Ald. Spiker asked if he remembers what did he said to MPD on that day.
The applicant said that he does not remember because it happened months ago.
Ald. Spiker read the report that says the applicant told the police that the patron was shot somewhere else and ran into his business.
Individuals in objection:
Valerie Benton – 5159 N 49th St – said that this establishment is located in a neighborhood with homes around it, that it is very noisy and loud and that she has contacted MPD, Ald. Pratt’s office on different times/dates for incidents and noise nuisances and that nothing has been done. She added that MPD shows up but at very late hours when the establishment is closed and that her health has declined because the lack of sleep. She also said that she has recorded and documented everything.
Dynasty 5402 N 38th St – victim of the shooting – said that she was inside the establishment, that she was caught in the middle of the shooting when she came out of the bathroom with her aunt, that the establishment was open still and that she fell on the ground because both of her legs were shot and that no one helped her except for her aunt who happens to be a nurse. She added that no one reached out to her after the incident, that she still upset and attending therapy because she suffers post-traumatic stress. She also mentioned that she was the one who contacted the business owner and that he was rude to her and did not even apologize.
Ald. Pratt said that she just had two walks yesterday and that neighbors complained about the garbage, the noise, loud patrons and that definitely this business has brought discomfort to the neighbors. She added that she agrees that it is a residential area and that neighbors deserve respect and peace.
The applicant said that he is doing what he can, that he is all up for learning and that he never heard anything from the neighbors before.
Ald. Moore asked the applicant how much time had passed after the shooting when the victim reached out to him.
The applicant said after 2 months.
Ald. Moore asked the applicant if he did any diligences to reach out to the victim before she did reach out to him.
The applicant answered “no”.
Ald. Pratt moved nonrenewal based upon the preponderance of the evidence in the police report, neighbors, applicant and aldermanic testimony that demonstrates the operation results in a threat to health, safety or welfare of the public and the history of the disciplinary actions. She added that the street has come a quieter and cleaner place and that there are other businesses following his lead.
Mr. Stokes - 928 N 29 – said that he has been part of the community for his entire life and that he has seen many changes since this store opened. He added that he gives opportunities to people and that he is been working with him for over a year now.
Mr. Rouse - 1905 N 58th St – said that he has seen changes on Vliet St since the applicant is there, that his girlfriend works for the applicant and that he is always uplifting people.
Ald. Burgelis said that he is happy that such a good businessman is involved with the neighborhood association and the area in general and moved to amend the application including precious metal & gem dealer. There were no objections.
Mr. Ellzey asked the applicant if he is willing to close at 10pm because all the stores except for the gas station close at 10pm.
The applicant said that he is fine amending the closing hours.

Brian Gemoll – 3170 S 77th St - said that he shares the corner of his backyard with this business, that he is not objection to the business but to the issue with people leaving garbage behind and the poor management. He added that he finds boxes of pizza sitting on his patio table, mailbox, window and all over his backyard. He added that the store is small and that people stand on the parking lot loitering and littering as well.
Ald. Burgelis asked about the screening process for employees because it seems that it has been an issue.
Ms. Ramos said that basically they were hiring anyone looking for a job and now they have to go thru interviews to move forward with the process, and that background checks are for people moving up the latter.
Ald. Burgelis said that the problem is that they do not do background checks on all the staff members and that they really do not know who they are hiring. He asked Ms. Ramos to explain what is she doing different than before.
Ms. Ramos said that the application is submitted online and that there are questions about being convicted, felony charges, etc. She added that HR forwards the screened applications to them in order to move forward with that individual because as a corporation, they are not allowed to make questions about backgrounds.
Ald. Burgelis asked who is responsible for maintaining the parking lot.
Ms. Ramos answered that they are.
Ald. Burgelis asked how often they monitor the parking lot.
Ms. Ramos said that they are doing checks 3x/day like at other stores and that they probably need to use a lock with a key bar code to avoid issues by the dumpster.
Ald. Burgelis asked how many surveillance cameras they have.
Ms. Ramos said that they have between 3 and 6 (360 degrees) cameras per store.
Ald. Burgelis asked if there is a camera on the parking lot.
Ms. Ramos said that they don’t have an outside camera but that they can install one given the situations on the police report.

She added that within the last year, this operator have been discovered operating without a valid license, that orders to cease operations have been issued and that the operator have chosen to continue operations 8 times after (within a month). She also said that the inspector explained them the process, that they were not able to operate unless they have a valid license and asked to keep the "closed" placard up but that they continued to remove it each time. She said that she wanted to bring this conversation before Council to make sure that they understand the requirement for a license and that they cannot operate unless they have a valid one.
Ald. Zamarripa asked if they received citations.
Ms. Hegarty said that they were cited for operating without a license and removal of the placard each time.
Ald. Zamarripa asked if they have paid the fines.
Ms. Hegarty said that out of 18 citations all but 4 were dropped, 2 were paid and that 2 seems to be pending.
Atty. Halbrooks said that this location was run by these two applicants and that they wanted to continue after the father stepped out. He added that an accountant decided to set up a new LLC which it led to an entire new administrative process for a place that never had violations or health issues. He added that there was an incident where a semi vehicle hit the light pole knocking down the business sign which it needed to be replaced in order to complete the electrical inspections required by DNS. He said that the applicants kept on opening the store in a desperate measure to get the $5K needed to replace the sign and to stay on business. He also said that the HD is correct, that his clients received a bunch of citations that were addressed at the municipal court and that the judge used his discretion to drop some of them. He added that his clients plead guilty for 4 of them and that they are in a payment plan. He said that the license lapsed because the mailbox was stolen and they did not receive the renewal form. He asked the committee to make a different decision and to grant the license with a warning letter instead.
Mr. Cooney explained that the MHD objection is about the fact that they were asked to cease operations after May 9th and that they chose to operate after.
Ald. Spiker asked the applicant if he reached out to the alderwoman’s office after having the electrical issues.
The applicant said that they did not.
Ald. Spiker said that it was very disrespectful to operate without a license after receiving the first citation and despite the fact that the provisional license was denied. He added that the applicant took his sweet time by reopening the business, getting caught, having citations being drop down to 4 and being in a payment plan for 4 because he needed to do what he did but that he also need to be licensed by the City to legally operate. He added that the applicant showed a disdain for the process.
Ald. Zamarripa asked how many times the applicant removed the placard.
Ms. Hegarty said that it was 10 times.
Ald. Burgelis asked for the dates when they were asked to cease operations.
Ms. Hegarty said that the dates were May 10, 12, 13, 15, 17, 20, 21, 25, 29 and June 1.
Atty. Halbrooks said that many citations were written on the same day.
Ms. Hegarty explained that Atty. Halbrooks is right in the way that they received the citations at once but it is because they were written on the same day and take a significant amount of time to write one. She added that each time that the inspector talked to the applicant, he explained that they were going to receive a citation for each violation and that the applicant acknowledged to the inspector that it was his choice to reopen. She also said that there is a photo to support each of the observations.
The applicant said that his intention was not to override the MHD orders but that they were desperate to stay in business.
Ald. Spiker said that it was clearly his intention to override the MHD orders.

The applicant answered that it is but that he is not in contact with minors because he is working in the kitchen. He added that his parole agent told him that he can work on the back of the restaurant and that he cannot be at the dining area where the families/customers are.
Ald. Burgelis asked the applicant if he would be willing to amend his plan of operations to restrict people under the age of 18 from entering his business.
The applicant said that he does not understand why he is being asked for that if he is not at the front/dining area and that his wife is in charge of the business.
Ald. Burgelis said that he is not comfortable renewing the licenses without that restriction and that he is talking from a personal experience being a restaurateur before.
Sgt. Velasquez said that Officer Monreal got some clarification on the case and that the applicant pled no contest to neglecting a child charge and that the provisions are no contact with the accuser and the accuser’s mother and no unsupervised contact with anyone under age of 18 years old except for a family member.
Ald. Perez said that for the context, this was a pretty egregious charge and that the committee keep it open waiting for disposition, that we know what the final disposition is and that all members have raised great points of concerns. He recommended amending the license that the applicant can’t be on the floor and that he was told by the City Attorney that this would be difficult to defend for a nonrenewal or suspension.
The applicant said that he is willing to restrict his access to the dining/common area.
Ald. Perez said that he was also advised to keep the item open in case of any violation within the renewal period because both can be taken into account.

Ald. Bauman said that he has issues with this parking lot which is directly across the street from the Intermodal station and that many visitors come/leave the city by train and parking on this lot and at the Amtrak lot. He added that there have been issues on both lots but that the other lot has taken significant steps to mitigate the security issues like live security for most of day and night hours and looking to get the state of Wisconsin to install a fence around the entire perimeter, to provide gates and to perhaps lock the lot for vehicles parked overnight since there is not train service during the night hours. He explained that the PA33 from the February 14, 2023 incident clearly says that there is an empty guard shack, no people, no fencing whatsoever and that the lot is totally accessible from all directions. He also said that to the applicant’s credit, he did a little landscaping but the sod has not been repaired after the plow season. He said that he is not sure if the trees will survive. Ald. Bauman said that he opposes granting this license because the operator cannot commit to fencing the lot neither adding live security.
Ald. Burgelis asked the applicant if he has another plan besides the 4 cameras hanging from a pole.
Ms. Mirr said that they can look into adding live security and that she is not sure about fencing in.

Mr. Singh (son) said that they bought this business like a year ago and that they have been cleaning it up and that is why they are applying for the liquor license because neighbors have asked them to sell liquor at the store. The applicant said that he has 6 years of experience in the business.

Individuals in opposition:
Kallage Kokugonza - 3115 W Kilbourn Av – said that she is representing the Historic Concordia Neighborhood Committee that strongly opposes to any liquor store because there are already too many drunk people in their community. She added that there are 2 other establishments that sell liquor. She added that they need stores that sell avocados not alcohol.
Savanah Brooks – Outreach Coordinator New West Side Partners – said that the organization opposes to the license despite the fact that they have been working with the applicant and his son on minor changes. She added that they do not deserve a liquor license because there is public drinking in front of the store, loitering and drug use.
Ald. Bauman asked Ms. Brooks if she personally has witnessed what she described.
Ms. Brooks answered “yes.
Hassani Lucas – Security Ambassador for Near West Side Partners – said that they are opposing to the liquor license because the applicant’s concern is to get the liquor license and not what is happening in front of his store. She said that through the walks they come up with safety tactics to help make the store a thriving business while keeping the community safe. She added that she has documentation and pictures available if needed. She also said that there is people doing drugs even on the roof of the store and behind the dumpster.
Alexander Kainz– 3223 W Highland Blvd. – said that he observes regularly numerous people loitering around the business with same behaviors as described before, the drunkenness and drug use are the most common. He added that this is a food dessert and that stores with fresh foods are needed instead.
Sally Wiberg – 946 N 31st St – said that she walks everyday in the neighborhood and she sees garbage, people drinking, throwing garbage, looting behaviors, public urination around the store always.
Sally Maddick - 735 N 34th St - said that she has lived in the area over 42 years with many challenges but that they have worked diligently to turn the area around like the brand new Harley Davidson Park and the new Concordia on 27th and Wells St. She added that homeownership has grown up substantially in the area. She added that this location has been a problem before and still does, that neighbors have testified over an over to close down businesses there for the same problems as described by the other witnesses. She also mentioned that the traffic has become a problem with illegal U-turns, illegal parking, double parking, etc.
Laura Sue Mosier (Schuster Mansion) - 3209 W. Wells St – said that she lost business because the previous liquor store which was not a good curb appeal. She added that she has worked hard along with her husband and invested over 1.5 million dollars and that she opposes to other store coming in and hurt the neighborhood again.
James Dieter – 2432 W Kilbourn Av – said that they have about 6 liquor stores in the area where anybody can walk to at one time and that they do not need another one. He added that the hard liquor is the problem and that they want to live at peace.
Chris McCartney - 2536 W Wells – said that he is developer, that he lives in the area and that safe housing should be a priority instead of liquor licenses. He added that he does not know how selling alcohol would benefit the neighborhood.

Ald. Bauman urged the committee to deny this license based upon the preponderance of the neighborhood testimony. He added that no matter who owns it, there is a record of numerous issues along the years that it has affected the neighborhood. He added that he lives close by and that he is also firsthand testimony of the issues presented by the neighbors.
The applicant said that they have built something from nothing in a year and that they are asking the people to leave, that they have cameras and that they are there for 3-4 hours everyday. He also said that he personally picks up trash and that it is understood that they need some time to improve things at the store.
Ald. Burgelis moved denial based upon the preponderance of the evidence in the neighborhood and aldermanic testimony. There were no objections. (Prevailed 5-0)

He added that along those lines, the neighbors requested that the patio be removed from the premises description (section 9) because the noise impacts the neighborhood; they want the hours of operations to get adjusted (section 10) so the bar closes at 12am Sun-Thu and at 1am Fri-Sat because there is no official parking lot and patrons will spill into the neighborhood.He added that on section 5, the applicant stated to have 3 in-house training security guards but that at the meeting, the applicant said that he was going to hire private security so they would like to see that change reflected. He also mentioned that for section 3, the neighbors want to clarify that DJ equipment won’t be used for any of the shows as accorded at the meeting and that any live music will conclude by 10pm.

He continued saying that there are 2 calls that are considered serious because it is related to the business (robbery).
Mr. James explained that the car incident was investigated and what happened was that one person took the other’s car without permission.
The applicant said that they have seen a decrease in the number of calls related to the business operations, that they are getting good reviews because of the practices and the investment made on the property.
Ald. Spiker said that this year there are 17 calls compared to the 7 from last year and that he does not know if the severity is lesser but that he would like to see the applicant posting resources for individuals in need of support for domestic violence and crisis intervention.
The applicant agreed to do that.
