Analysis
This resolution authorizes payment of attorney fees and costs due to the Milwaukee Police Association and its attorneys Cermele & Matthews, S.C., in the complaint entitled In the Matter of the Citizen Complaint re: Toccaro Harris, for the total amount of $17,770.
Body
Whereas, Cermele & Matthews, S.C., on behalf of the Milwaukee Police Association, represented Milwaukee Police Officers Richard Michalak and Jacob Baczek relating to a citizen complaint filed by Mr. Toccaro Harris; and

Whereas, Legal representation was occasioned by Fire and Police Commission proceedings pursuant to a citizen complaint by Mr. Toccaro Haris; and

Whereas, Cermele & Matthews, S.C. performed 74.30 hours of service; and

Whereas, The Board of Fire and Police Commissioners ordered dismissal of the complaint on March 8, 2023; and

Whereas, Under the Wisconsin Public Records Law, successful litigants are entitled to reasonable costs and attorney fees; and

Whereas, The City Attorney recommends that the City of Milwaukee pay attorney fees and costs in the amount of $17,770 to the Milwaukee Police Association and its attorneys; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are authorized and directed to issue a City check in the amount of $17,770, payable to the order of Cermele & Matthews, S.C., as soon as practicable, in full and final payment of attorney fees and costs, the amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300; and, be it

Further Resolved, That for and in consideration of the above-referenced payment, this matter is fully and finally resolved.
