Atty. Maistelman said that given the issues in the police report, they have sat down with the staff to review all the procedures and that MPD has access to the surveillance system (passwords shared).

Atty. Maistelman said that Ald. Dimitrijevic is right, that his client thought he had it as this premises was previously licensed for extended hours and that there are no items in the police report that occurred during that period.
Ald. Dimitrijevic said that there are no items in the police report during that period of time but negative things happened around the neighborhood.
Ald. Zamarripa noted that the Extended Hours license was just approved this January.

Ald. Dimitrijevic said that there was some miscommunication between her office and the License Division, that she always checks with MPD too and that there were situations like people hanging out after hours when there was no extended hours license in place.
The applicant said that the panhandling and loitering are also happening at the neighboring business and that he is working with them as well.
Atty. Maistelman said that he recognizes that issues happened this last year but that his client did not have issues before.
The applicant said that he has many customers who goes to the store during his break while working third shift.
Ald. Dimitrijevic said that the issues started to happen recently and that she wonders if the applicant is considering to change the hours for the store and not for the pumps.
Atty. Maistelman said that they are not willing to change the hours.
Sgt. Velasquez said that no citations were issued for that item during the extended hours license.
Ald. Dimitrijevic said that she does not understand why the applicant did not receive a citation for being open during extended hours without a license.
Atty. Maistelman said that he was not prepared to talk about the extended hours licenses that was approved on January without any issues and that his client has not had any issues after hours. He added that they are willing to work with MPD to avoid any issues and asked that the licenses be renewed.

Natasha Williams – said that she prefers not to give her address – explained that her problem is the amount of garbage without a receptacle, that there are rats everywhere and that she is tired of reporting this to the alderman’s office and to the applicant. She added that the applicant uses the alley to park vehicles and that she has to get out from her vehicle to ask them to remove the vehicles when she wants to get in her garage late at night.
The applicant asked Ms. Williams why she did not go to yesterday’s meeting.
Ms. Williams said that she had talked to him numerous times without a proper response.
Stephanie Harling – Executive Director BID 31 – said that she has had conversations with the applicant regarding the trash, that she has offered assistance getting cameras in the alley and that there is lack of cooperation from the applicant. She added that she expects it to change today because this business has negatively affected the community.
Individuals also present:
Ald. Chambers said that he has had extensive conversations with the applicant prior to yesterday’s neighborhood meeting, that the applicant has made some changes to the plan of operations like getting a larger trash receptacle and having it picked up twice/wk.
Ald. Brower moved to amend the plan of operations to include a larger trash receptacle (more than four cubic yards) and two pickups per week. There were no objections.
Ald. Chambers recommended approval with a 20 (twenty) day suspension to rectify the issues that the applicant knows he needs to work on.
The applicant said that this is his first business and that he works hard every day to do things better, that he does good deeds for the community and keeps communication open with Ald. Chambers.
Ald. Pratt moved approval with a 20 day suspension as amended of the Class B Tavern, Public Entertainment Premises and Food Dealer Licenses based upon the preponderance of the evidence in the police report, aldermanic, applicant and neighborhood testimony that demonstrates the operation results in a threat to the health, safety or welfare of the public for the failure to comply with the approved plan of operations.
